1 <br />2 <br />3 <br />4 <br />5 <br />ORDINANCE NO. 7635 <br />AN ORDINANCE OF THE CITY OF RIVERSIDE, CALIFORNIA, <br />GRANTING AN EXCLUSIVE FRANCHISE TO ARAKELIAN <br />ENTERPRISES, INC. DOING BUSINESS AS ATHENS SERVICES FOR <br />RESIDENTIAL AND COMMERCIAL SOLID WASTE, GARBAGE, <br />RECYCLABLE MATERIAL, AND ORGANIC WASTE COLLECTION <br />SERVICES ALONG AND UPON THE STREETS OF THE CITY OF <br />RIVERSIDE. <br />6 WHEREAS, the City of Riverside ("City") is a community of about 314,998, ranked as the <br />7 12th most populous city in California, with projected annual growth of 0.51%. Currently, there are <br />8 63,484 Residential Solid Waste Accounts and 7,408 Commercial Accounts; and <br />9 WHEREAS, current solid waste collection services are provided through a combination of <br />10 City staff and franchise agreements; and <br />11 WHEREAS, City collection staff provide residential collection services for approximately <br />12 two thirds of the City's residential customers; the remaining one third of residential customers are <br />13 currently serviced by Burrtec Waste Industries through an exclusive agreement, which expires on <br />14 June 30, 2023; and <br />15 WHEREAS, commercial collection service is provided through non-exclusive agreements <br />16 with Burrtec Waste Industries, Arakelian Enterprises, Inc. dba Athens Services, and CR&R <br />17 Environmental Services. These agreements have been in place since 2001 and are set to expire on <br />18 June 30, 2023; and <br />19 WHEREAS, Public Resources Code section 40059 provides that a City may determine that <br />20 aspects of solid waste handling are a matter of local concern and that the City may contract for such <br />21 services with or without use of a competitive bidding process. Section 40059 further provides that <br />22 the governing body of a local government agency may by resolution or ordinance, prescribe terms <br />23 and conditions upon which authority to provide solid waste handling services may be granted; and <br />24 WHEREAS, on August 18, 2022, the City issued RFP No. 2219, soliciting qualified vendors <br />25 to submit proposals for Residential and Commercial Garbage, Recyclable Material, and Organic <br />26 Waste Collection Services; and <br />27 <br />28 <br />1 <br />
