CITY OF RIVERSIDE CItY COUNCIL MEMORANDUM IIII People Serving People HONORABLE MAYOR AND CITY COUNCIL DATE: April 6, 2004 ITEM NO: 25 SUBJECT: APPOINTMENT OF MASSAGE APPEAL COMMITTEE BACKGROUND: Section 5.52.100 of the Riverside Municipal Code requires two members of the City Council and a third member who is either a licensed physical therapist or medical doctor, if possible, be appointed to a Massage Appeal Committee for a term of one year for the purpose of hearing massage permit appeals. The City Attorney shall be an ex officio member with no right to vote. On March 19, 2004, an appeal was received from Cai Hua Hu prompting appointments to the Committee. Traditionally, two members of the City Council Public Safety Committee have served. Chair Steve Adams and Member Adkison (who served for two other appeals) have agreed to serve. Dr. Pena, a licensed chiropractor, who also served for the prior two appeals has agreed to continue on the Committee if the City Council so desires. Dr. Pena brought valuable expertise to the appeal committee deliberations. FISCALIMPACT: There is no fiscal impact associated with the Committee appointments. Staffing of the appeal committee meetings will be absorbed with existing personnel and resources. ALTERNATIVES: (1) Not appoint the Councilmembers named above to this Committee and instead appoint two different Councilmembers, however, the City Council has traditionally appointed two members of the Public Safety Committee and Councilmember Adkison has experience with massage appeals; and (2) not appoint Dr. Pena and instead appoint a different third member who is willing to serve as recommended by the City Council. RECOMMENDATION: That the City Council appoint Councilmembers Steve Adams and Ed Adkison and Dr. Pena to the Massage Appeal Committee for the purpose of hearing massage permit appeals for a one-year term. g:\clk\docs\massage appeal council report 25-1
