The applicant's proposal includes a grading plan with <br />three multi level pad areas containing a total of 38,189 square feet to facilitate the construction <br />of a 8,014 square foot single story dwelling and a 2,000 square foot single story auxiliary dwelling <br />unit. The proposal includes a variance request for dwelling height, to allow an auxiliary dwelling <br />unit to be located forward of the rear most wall of the primary dwelling and to allow an auxiliary <br />dwelling unit that exceeds the maximum permitted area. The Zoning Administrator approved the <br />variance for dwelling height and denied the request to locate a 2,000 square foot auxiliary dwelling <br />unit forward of the rear most wall of the primary dwelling. Due to the large size of the proposed <br />pad and its encroachment into the boundaries ofthe Alessandro Arroyo the Zoning Administrator <br />also denied the exceptions from the grading ordinance to allow an encroachment into the <br />Alessandro Arroyo and the required 50 foot setback, to allow a pad containing 38,189 square feet <br />where a maximum of 21,000 is permitted and to allow the slopes to exceed the maximum <br />permitted vertical height (see Exhibit B). <br /> <br />The applicant has appealed this decision and submitted a revised grading plan that reduces the <br />total graded pad area from 38,189 to 35,000 square feet by decreasing the size of the two smaller <br />pads proposed to be located within the boundaries of the Alessandro Arroyo from 7,893 to 4,704 <br />square feet (see Exhibit A). The size, design and location of the proposed single family dwelling <br />and auxiliary dwelling unit remain the same. Although the pad area has been reduced all the <br />original variances and grading exceptions continue to be required and the recommendations of <br />the Zoning Administrator remain unchanged. <br /> <br />RECOMMENDATION <br /> <br />That the City Council: <br /> <br />1. Approve the variance for a maximum one story, 25.5 foot high dwelling. <br /> <br />2. Deny the minor conditional use permit and related variances to allow an approximately <br />2,000 square foot auxiliary dwelling unit located forward of the rear wall of the primary <br />dwelling. <br /> <br />10-1 <br />
