BOARD OF PUBLIC UTILITIES <br />MINUTES <br />MONDAY, FEBRUARY 13, 2023, 6:30 P.M. <br />PUBLIC COMMENT IN-PERSON/TELEPHONE <br />City SArts&Innovation ART PICK COUNCIL CHAMBER <br />3900 MAIN STREET, RIVERSIDE, CA 92522 <br />PRESENT: Chair David Crohn, Vice Chair Rebeccah Goldware, and Board Members <br />Rosemary Heru, Gary Montgomery, Gil Oceguera, Peter Wohlgemuth, and <br />Member Nipunjeet Gujral (arrived at 6:44 p.m.) <br />ABSENT: Member Nancy Melendez <br />Chair Crohn called the meeting to order at 6:30 p.m. <br />Member Oceguera led the pledge of Allegiance to the Flag. <br />ORAL COMMUNICATIONS FROM THE AUDIENCE <br />There was no one wishing to address the Board of Public Utilities. <br />CONSENT CALENDAR <br />It was moved by Member Oceguera and seconded by Member Wohlgemuth to approve <br />the Consent Calendar as presented below affirming the actions appropriate to each item. <br />The motion carried with Chair Crohn, Vice Chair Goldware, and Members Heru, <br />Montgomery, Oceguera, and Wohlgemuth voting aye, and Members Gujral and Melendez <br />absent. <br />MINUTES <br />The minutes of the meeting of January 23, 2023, were approved as presented. <br />HOLIDAY MEETING SCHEDULE <br />The Board of Public Utilities approve the cancellation of the regularly scheduled Board of <br />Public Utilities meetings for March 27, October 9, and December 25, 2023, due to holidays. <br />LEGAL BUDGET FOR LAW FIRM TO DEFEND CITY IN CASE ENTITLED PONGS V. CITY OF RIVERSIDE, <br />A REVERSE VALIDATION LAWSUIT CHALLENGING VALIDITY OF CITY -ISSUED MUNICIPAL BONDS <br />The Board of Public Utilities recommends that the City Council approve a legal budget for <br />the law firm of Stradling Yocca Carlson & Rauth in an amount not -to -exceed $109,050 to <br />defend the City in the case entitled Pongs v. City of Riverside, a reverse validation lawsuit <br />challenging the validity of City -issued municipal bonds. <br />DISCUSSION CALENDAR <br />LEGAL UPDATE - BROWN ACT REQUIREMENTS FOR TELECONFERENCE MEETINGS - ASSEMBLY <br />BILL 2449 <br />Following discussion, it was moved by Member Oceguera and seconded by Member <br />Montgomery to receive and ordered filed the presentation from the City Attorney's Office <br />regarding Assembly Bill 2449.
