<br />S <br /> RIVERSIDE PUBLIC UTILITIES <br /> Board Memorandum <br /> <br />BOARD OF PUBLIC UTILITIES DATE: MAY 23, 2022 <br /> <br />SUBJECT: RIGHT OF ENTRY AND TEMPORARY CONSTRUCTION EASEMENT <br />AGREEMENT WITH THE RIVERSIDE COUNTY FLOOD CONTROL AND WATER <br />CONSERVATION DISTRICT FOR A STAGING AREA ON CITY-OWNED <br />PROPERTY, ASSESSOR PARCEL NO. 0277-022-75, TO FACILITATE <br />CONSTRUCTION AND IMPLEMENTATION OF THE RIGHT AND LEFT LEVEE <br />DIVERSION KNOWN AS THE RIVERSIDE LEVEE SANTA ANA RIVER <br />STABILIZATION PROJECT FROM JUNE 1, 2022 TO DECEMBER 31, 2026, <br />WITH A REVENUE TOTAL OF $2,606,202 <br />ISSUE: <br />Consider recommending that the City Council approve the Right of Entry and Temporary <br />Construction Easement Agreement with Riverside County Flood Control and Water Conservation <br />District on City-owned property to facilitate the construction and implementation of the right and <br />left levee diversion known as the Riverside Levee Santa Ana River Stabilization Project for a term <br />from June 1, 2022 to December 31, 2026, with a total revenue of $2,606,202. <br />RECOMMENDATIONS: <br />That the Board of Public Utilities recommend that the City Council: <br />1. Approve the Right of Entry and Temporary Construction Easement Agreement with <br />Riverside County Flood Control and Water Conservation District for a staging area on a <br />portion of City-owned property, 0277-022-75, to facilitate <br />construction and implementation of the Right and Left Levee Diversion known as the <br />Riverside Levee Santa Ana River Stabilization Project for a term from June 1, 2022 to <br />December 31, 2026, for total compensation of $2,606,202 to the City; and <br /> <br />2. Authorize the City Manager, or designee, to execute the Right of Entry and Temporary <br />Construction Easement Agreement, including making minor, non-substantive changes, <br />and sign all documents and instruments necessary to complete the transaction. <br />BACKGROUND: <br />In 1950, the construction of the Riverside levees were federally authorized under the Flood <br />stnd <br />Control Act - Public Law 516, 81 Congress - 2 Session (Act). In 1956, the County Board of <br />Supervisors provided a guaranteed to the Secretary of the Army that the Riverside County Flood <br />Control and Water Conservation District (District) would provide local cooperation as required and <br />defined in Resolution No. 265 and Resolution No. 293. These Resolutions were adopted on <br />January 13, 1956, for Riverside Levee 1 and Riverside Levee 2. In 1958, the levees were <br /> <br />
