1 ORDINANCE NO. 6054 <br /> 2 AN ORDINANCE OF THE CITY OF RIVERSIDE, CALIFORNIA, <br /> AMENDING CHAPTER 5.58 OF THE RIVERSIDE MUNICIPAL <br /> 3 CODE RELATING TO SECURITY ALARM SYSTEMS BY <br /> AMENDING SECTION 5.58.180 TO DELETE THE PROVISIONS <br /> 4 RELATING TO THE SUSPENSION OF AN ALARM USER'S <br /> PERMIT AND TO REVISE THE PROVISIONS FOR THE <br /> 5 REVOCATION OF A PERMIT INCLUDING THE APPEAL <br /> PROCEDURES RELATED THERETO. <br /> 6 <br /> The City Council of the City of Riverside, California, does <br /> 7 <br /> ordain as follows: <br /> 8 <br /> Section 1: Section 5.58.180 of the Riverside Municipal <br /> 9 <br /> Code is hereby amended to read as follows: <br /> 10 <br /> "5.58.180 REVOCATION OF ALARM USER'S PERMIT. <br /> 11 <br /> (a) After the fifth false robbery alarm or <br /> 12 the tenth false burglary alarm within any three <br /> hundred sixty-five (365) day period, the Police <br /> 13 Chief may serve the permittee with a notice of <br /> intention to revoke the alarm user's permit. The <br /> 14 notice of intention to revoke shall state the <br /> reason or reasons for such revocation and shall <br /> 15 set forth the procedure to appeal the proposed <br /> revocation. Service of the notice of intention to <br /> 16 revoke shall be deemed made immediately upon <br /> personal service on the permittee or seventy-two <br /> 17 (72) hours after the notice has been deposited <br /> with postage prepaid in the United States mail <br /> 18 sent to the last known address of the permittee. <br /> 19 (b) The revocation shall be effective the <br /> sixteenth (16th) day after the service of the <br /> 20 notice of intention unless an appeal is timely <br /> filed. The notice of intention to revoke may be <br /> 21 appealed to the City Manager provided that a <br /> notice of appeal has been filed with the City <br /> 22 Manager's Office no later than the fifteenth <br /> (15th) day after service on the permittee of the <br /> 23 notice of intent to revoke. The City Manager or <br /> the appointed designee of the City Manager shall <br /> 24 set the matter for a hearing, which hearing shall <br /> be within thirty (30) days after receipt of the <br /> 25 notice of appeal or such longer period as may be <br /> agreed to by the permittee.
