1 BOARD OF ETHICS SPECIAL MEETING WEDNESDAY, OCTOBER 14, 2020, 5 P.M. VIRTUAL MEETING MINUTES PRESENT: Chair Nelson, Vice Chair Stahovich, Members Ford, Graham, Huerta, Foley, Ford, Keen, and Vega ABSENT: Member Newman STAFF PRESENT: Eva Arseo and Brandon Mercer Chair Nelson convened the Board of Ethics meeting at 5:02 p.m. The Pledge of Allegiance was given to the Flag. ORAL COMMUNICATIONS FROM THE AUDIENCE Jason Hunter spoke regarding Charter Officers and the Code of Ethics. WAIVER OF HEARING RULES AND PROCEDURES - WRITTEN STATEMENT OF FINDINGS AND DECISION FOR HUNTER V. PLASCENCIA - SEPTEMBER 30, 2020 Following discussion, it was moved by Member Stahovich and seconded by Member Huerta that the Board of Ethics waive the provision of Paragraph 13 of the Board of Ethics Hearing Rules and Procedures requiring approval of the Statement of Findings and Decision for Hunter v Plascencia at the next regular Board of Ethics meeting. The motion carried unanimously. Following discussion, it was moved by Panel Member Stahovich and seconded by Panel Member Huerta to approve the Statement of Findings and Decision for Hunter v. Plascencia. The motion carried with Members Huerta, Foley, Stahovich, and Keen voting aye and Member Newman absent. ITEMS FOR FUTURE BOARD CONSIDERATION AS REQUESTED BY BOARD OF ETHICS MEMBERS Chair Nelson requested training on the role of the City Attorney versus City Council making final decisions and review of the amendments to the Sunshine Ordinance for discussion. Member Foley requested training on the evaluation of evidence and the decision-making process. Member Huerta requested a discussion on adding evidence presented by the public to the record and an on-going review of Code of Ethics Rules and Procedures. The meeting adjourned at 5:45 p.m.
