1 <br /> <br />BOARD OF ETHICS <br />SPECIAL MEETING <br />WEDNESDAY, OCTOBER 14, 2020, 5 P.M. <br />VIRTUAL MEETING <br /> <br />MINUTES <br /> <br />PRESENT: Chair Nelson, Vice Chair Stahovich, Members Ford, Graham, <br />Huerta, Foley, Ford, Keen, and Vega <br /> <br />ABSENT: Member Newman <br /> <br />STAFF PRESENT: Eva Arseo and Brandon Mercer <br /> <br />Chair Nelson convened the Board of Ethics meeting at 5:02 p.m. <br /> <br />The Pledge of Allegiance was given to the Flag. <br /> <br />ORAL COMMUNICATIONS FROM THE AUDIENCE <br />Jason Hunter spoke regarding Charter Officers and the Code of Ethics. <br /> <br />WAIVER OF HEARING RULES AND PROCEDURES - WRITTEN STATEMENT OF FINDINGS <br />AND DECISION FOR HUNTER V. PLASCENCIA - SEPTEMBER 30, 2020 <br />Following discussion, it was moved by Member Stahovich and seconded by <br />Member Huerta that the Board of Ethics waive the provision of Paragraph 13 of <br />the Board of Ethics Hearing Rules and Procedures requiring approval of the <br />Statement of Findings and Decision for Hunter v Plascencia at the next regular <br />Board of Ethics meeting. The motion carried unanimously. <br /> <br />Following discussion, it was moved by Panel Member Stahovich and seconded <br />by Panel Member Huerta to approve the Statement of Findings and Decision for <br />Hunter v. Plascencia. The motion carried with Members Huerta, Foley, Stahovich, <br />and Keen voting aye and Member Newman absent. <br /> <br />ITEMS FOR FUTURE BOARD CONSIDERATION AS REQUESTED BY BOARD OF ETHICS <br />MEMBERS <br />Chair Nelson requested training on the role of the City Attorney versus City Council <br />making final decisions and review of the amendments to the Sunshine Ordinance <br />for discussion. Member Foley requested training on the evaluation of evidence <br />and the decision-making process. Member Huerta requested a discussion on <br />adding evidence presented by the public to the record and an on-going review <br />of Code of Ethics Rules and Procedures. <br /> <br />The meeting adjourned at 5:45 p.m.
