1 ORDINANCE NO. 6048 2 AN ORDINANCE OF THE CITY OF RIVERSIDE, CALIFORNIA, AMENDING SECTION 10.60.080 OF THE RIVERSIDE MUNICIPAL 3 CODE TO PROHIBIT THE LEAVING OF ANIMALS IN VEHICLES PARKED IN CITY PARKING FACILITIES. 4 5 The City Council of the City of Riverside, California, does 6 hereby ordain as follows: 7 Section 1: Section 10.60.080 of the Riverside Municipal 8 Code is hereby amended to read as follows: 9 "10.60.080 LEAVING ANIMAL IN VEHICLE. It is unlawful to leave any animal in a parked vehicle 10 or permit any animal to be upon any parking facility under the following circumstances: 11 1) The weather is or is likely to expose 12 the animal to pain and suffering; or 13 2) The animal is able to escape the vehicle; or 14 3) The animal is able to make any physical 15I contact with any person situated outside the vehicle. 16 It shall be within the discretion of the Humane 17 Society Officer or other authorized law enforcement agent of the City to determine whether 18 the safety of the animal and the public is compromised by the placement of the animal in the 19 vehicle. The investigating or issuing officer may take into consideration the following factors: 20 temperature outside and inside vehicle, existence of food or water available to the animal, leash or 21 other confinement devices secured on the animal, position of windows on vehicle, conversations with 22 potential citee. Any animal permitted or found upon a parking facility in violation of this 23 section may be removed and impounded by the City's law enforcement officers or agents.~' 24 25 Section 2: The City Clerk shall certify to the adoption of 26 this ordinance and cause publication once in a newspaper of general 27 circulation in accordance with Section 414 of the Charter of the Attorney's Office Street CA 92522 ?~2-5567 F:\WPDATA\ORD~93062901 .JS
