(corrected) <br /> <br /> 1 ORDINANCE NO. 6037 <br /> 2 AN ORDINANCE OF THE CITY OF RIVERSIDE, CALIFORNIA, <br /> AMENDING CHAPTER 2.40 OF THE RIVERSIDE MUNICIPAL CODE IN <br /> 3 ITS ENTIRETY TO PROVIDE FOR AN ACCESSIBILITY APPEALS <br /> BOARD TO BE ESTABLISHED AS A PART OF THE BOARD OF <br /> 4 ADMINISTRATIVE APPEALS AND ZONING ADJUSTMENT. <br /> 5 The City Council of the City of Riverside does ordain <br /> 6 as follows: <br /> 7 Section 1: Chapter 2.40 of the Riverside Municipal <br /> 8 Code is hereby amended in its entirety and will now read as <br /> 9 follows: <br /> 10 "Chapter 2.40 <br /> 11 BOARD OF ADMINISTRATIVE APPEALS <br /> AND ZONING ADJUSTMENT <br /> 12 <br /> Sections: <br /> 13 2.40.010 Board of administrative appeals and <br /> zoning adjustment created. <br /> 14 2.40.020 Powers and duties. <br /> 2.40.030 Appeal procedure. <br /> 15 2.40.040 Variance procedure. <br /> 2.40.050 Continuing jurisdiction. <br /> 16 <br /> 2.40.010 BOARD OF ADMINISTRATIVE APPEALS AND ZONING <br /> 17 ADJUSTMENT CREATED. Pursuant to the provisions of Article <br /> VII of the City Charter, there is hereby created a Board of <br /> 18 Administrative Appeals and Zoning Adjustment, which shall <br /> consist of nine members plus three members who are persons <br /> 19 with disabilities, at least two of whom shall be mobility <br /> impaired, who shall serve only whenever the Board of <br /> 20 Administrative Appeals and Zoning Adjustment functions as an <br /> Accessibility Appeals Board. <br /> 21 <br /> 2.40.020 POWERS AND DUTIES. The Board of Administrative <br /> 22 Appeals and Zoning Adjustment shall have the following powers <br /> and duties: <br /> 23 (1) Hear the appeal of any person aggrieved by any <br /> order, act or determination of the building official or fire <br /> 24 marshal or their subordinates. In such capacity the Board is <br /> not vested with legislative authority and must act within the <br /> 25 framework of existing ordinances.
