(corrected) 1 ORDINANCE NO. 6037 2 AN ORDINANCE OF THE CITY OF RIVERSIDE, CALIFORNIA, AMENDING CHAPTER 2.40 OF THE RIVERSIDE MUNICIPAL CODE IN 3 ITS ENTIRETY TO PROVIDE FOR AN ACCESSIBILITY APPEALS BOARD TO BE ESTABLISHED AS A PART OF THE BOARD OF 4 ADMINISTRATIVE APPEALS AND ZONING ADJUSTMENT. 5 The City Council of the City of Riverside does ordain 6 as follows: 7 Section 1: Chapter 2.40 of the Riverside Municipal 8 Code is hereby amended in its entirety and will now read as 9 follows: 10 "Chapter 2.40 11 BOARD OF ADMINISTRATIVE APPEALS AND ZONING ADJUSTMENT 12 Sections: 13 2.40.010 Board of administrative appeals and zoning adjustment created. 14 2.40.020 Powers and duties. 2.40.030 Appeal procedure. 15 2.40.040 Variance procedure. 2.40.050 Continuing jurisdiction. 16 2.40.010 BOARD OF ADMINISTRATIVE APPEALS AND ZONING 17 ADJUSTMENT CREATED. Pursuant to the provisions of Article VII of the City Charter, there is hereby created a Board of 18 Administrative Appeals and Zoning Adjustment, which shall consist of nine members plus three members who are persons 19 with disabilities, at least two of whom shall be mobility impaired, who shall serve only whenever the Board of 20 Administrative Appeals and Zoning Adjustment functions as an Accessibility Appeals Board. 21 2.40.020 POWERS AND DUTIES. The Board of Administrative 22 Appeals and Zoning Adjustment shall have the following powers and duties: 23 (1) Hear the appeal of any person aggrieved by any order, act or determination of the building official or fire 24 marshal or their subordinates. In such capacity the Board is not vested with legislative authority and must act within the 25 framework of existing ordinances.
