1 <br /> <br />2 <br /> <br />3 <br /> <br />4 <br /> <br />5 <br /> <br /> 6 <br /> <br /> 7 <br /> <br /> 8 <br /> <br /> 9 <br /> <br />10 <br /> <br />11 <br /> <br />12 <br /> <br />13 <br /> <br />14 <br /> <br />15 <br /> <br />16 <br /> <br />17 <br /> <br />18 <br /> <br />19 <br /> <br />20 <br /> <br />21 <br /> <br />22 <br /> <br />23 <br /> <br />24 <br /> <br />25 <br /> <br />26 <br /> <br />27 <br /> <br /> RESOLUTION NO. 731 <br /> <br /> A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE <br /> CITY OF RIVERSIDE, CALIFORNIA, AUTHORIZING USE OF THE <br /> POLANCO REDEVELOPMENT ACT IN ORDER TO FACILITATE <br /> THE REDEVELOPMENT OF CERTAIN PROPERTIES THAT ARE <br /> OR MAY BE AFFECTED BY HAZARDOUS SUBSTANCES <br /> <br /> WHEREAS, the Redevelopment Agency of the City of Riverside (the "Agency") has <br />been duly created and is authorized to transact business and exercise its powers, pursuant to the <br /> <br />Community Redevelopment Law (California Health and Safety Code, Section 33000 et seq.)l; and <br /> WHEREAS, the Polanco Redevelopment Act ("Polanco Act") was enacted to assist <br /> <br />redevelopment agencies in the process of bringing contaminated properties, or brownfields, back into <br />>roductive use. (Sections 33459 et seq.); and <br /> <br /> WHEREAS, Section 33459.1 of the Polanco Act authorizes redevelopment agencies to <br />:ause the investigation and performance of feasibility studies on a site that is potentially impacted by <br />hazardous substances; and <br /> <br /> WHEREAS, Section 33459.1(a)(1) of the Polanco Act provides that a redevelopment <br />agency may take any actions that the agency determines are necessary and consistent with other state <br />and federal laws to remedy or remove a release of hazardous substances on, under, or from property <br />within a redevelopment project area, whether the agency owns that property or not; and <br /> <br /> WHEREAS, Section 33459.4 of the Polanco Act allows a redevelopment agency to <br />recover the cost for investigation, remediation, and removal of hazardous substances, if such actions <br />are undertaken by the Agency; and <br /> <br /> WHEREAS, Section 33459.3 of the Polanco Act provides immunity from environmental <br />liability to the redevelopment agency, owners and tenants (and their lenders) who own or occupy the <br />property after the cleanup has been completed, and any owner or responsible party who enters into an <br />agreement with the redevelopment agency to perform the cleanup; and <br /> <br /> WHEREAS, this Resolution qualifies for a categorical exemption under the Califomia <br /> <br />~All statutory references are to the California Health and Safety Code. <br /> <br />City Attorney's Office <br />3900 Main Street <br />Riverside, CA 92522 <br />(909) 826-5567 <br /> <br /> <br />
