1 ORDINANCE NO. 6121 <br /> 2 AN ORDINANCE OF THE CITY OF RIVERSIDE, CALIFORNIA, <br /> REPEALING CHAPTER 16.36 OF THE RIVERSIDE MIINICIPAL <br /> 3 CODE REQUIRING FENCING FOR SWIMMING POOLS AND BY <br /> AMENDING SECTION 16.08.030 OF SAID RIVERSIDE <br /> 4 MUNICIPAL CODE TO PROVIDE FOR THE ADOPTION OF <br /> DIVISION III OF APPENDIX CHAPTER 12 OF THE 1991 <br /> 5 EDITION OF THE UNIFORM BUILDING CODE RELATING TO <br /> BARRIERS FOR SWIMMING POOLS, SPAS AND HOT TUBS. <br /> 6 <br /> 7 WHEREAS Chapter 16.36 of the Riverside Municipal Code <br /> 8 provides that swimming pools and similar facilities two feet or <br /> 9 more in depth designed for wading, swimming or other <br /> 10 recreational purposes are to be enclosed in the manner <br /> 11 prescribed therein; and <br /> 12 WHEREAS on September 28, 1993, the California Building <br /> 13 Standards Commission adopted as emergency regulations Division <br /> 14 III of Appendix Chapter 12 of the 1991 Edition of the Uniform <br /> 15 Building Code entitled Barriers for Swimming Pools, Spas and <br /> 16 Hot Tubs; and <br /> 17 WHEREAS the California Building Standards Commission <br /> 18 postponed the effective date of these emergency regulations <br /> 19 until February 1, 1994, to permit notification of affected <br /> 20 parties and training of enforcement personnel; and <br /> 21 WHEREAS the adoption of Division III of Appendix <br /> 22 Chapter 12 of the 1991 Edition of the Uniform Building Code <br /> 23 will require all pools built on or after February 1, 1994 to <br /> 24 comply with fencing and alarm requirements provided therein; <br /> 25 and <br /> 26 WHEREAS it would be appropriate for the City of <br /> 27 Riverside to repeal its current regulations relating to fencing <br /> <br />Attorney's Office <br />Street <br />CA 92522 <br />782-5567 F:/WPDATA/ORDk94011001.
