1 ORDINANCE NO. 6116 <br /> 2 AN ORDINANCE OF THE CITY OF RIVERSIDE, CALIFORNIA, <br /> AMENDING SECTION 16.04.335 OF THE RIVERSIDE <br /> 3 MUNICIPAL CODE TO ALLOW THE BUILDING OFFICIAL, <br /> WITH THE CONCURRENCE OF THE PLANNING DIRECTOR, TO <br /> 4 GRANT AN ADDITIONAL TIME EXTENSION FOR PLAN REVIEW <br /> OF NOT MORE THAN 180 DAYS WHEN A SUBSTANTIAL <br /> 5 PORTION OF PLAN REVIEW DELAYS ARE EXCLUSIVELY <br /> CAUSED BY ABNORMAL PROCESSING TIME REQUIREMENTS OF <br /> 6 OTHER GOVERNMENTAL AGENCIES. <br /> 7 The City Council of the City of Riverside, California, does <br /> 8 ordain as follows: <br /> 9 Section 1: Section 16.04.335 of the Riverside Municipal <br /> 10 Code is hereby amended to read as follows: <br /> 11 "16.04.335 EXPIRATION OF PLAN REVIEW. An <br /> application for plan review for which no permit is <br /> 12 issued within one hundred eighty days following the <br /> date of such application shall expire as of the one <br /> 13 hundred eighty-first day, and plans and other data <br /> submitted for review may thereafter be returned to <br /> 14 the applicant or destroyed by the Building Official <br /> if said plans and data cannot be reasonably <br /> 15 retained. The Building Official may extend the time <br /> for action by the applicant for a period not <br /> 16 exceeding one hundred eighty days upon request by <br /> the applicant showing that circumstances beyond the <br /> 17 control of the applicant have prevented action from <br /> being taken. A further extension of one hundred <br /> 18 eighty days may be granted by the Building Official <br /> upon request by the applicant upon a showing that <br /> 19 circumstances beyond the control of the applicant <br /> have prevented action from being taken; provided, <br /> 20 however, the applicant must pay a plan review fee of <br /> one-half the original such fee. <br /> 21 When a substantial portion of plan review delays <br /> are exclusively caused by abnormal processing time <br /> 22 requirements of other governmental agencies involved <br /> in the plan approval process, the Building Official, <br /> 23 with the concurrence of the Planning Director, may <br /> grant an additional time extension of not more than <br /> 24 one hundred eighty days upon written request from <br /> the applicant documenting the reasons for the <br /> 25 delays.
