City of Riverside; (2) §54956.9 <br />to confer with and/or receive advice from legal counsel concerning one case <br />of anticipated litigation; and (3) §54957 for performance evaluation of the City <br />Manager. Assistant City Attorney Kathleen Gonzales announced that the <br />City Council in closed session unanimously authorized the initiation of an <br />action regarding the one case of anticipated litigation. The action, the <br />defendants, and other particulars shall, once formally commenced, be <br />disclosed to any person upon inquiry, unless to do so would jeopardize the <br />City's ability to effectuate service of process on one or more unserved <br />parties. The closed session regarding the City Manager's performance <br />evaluation was continued to later in the day (see Page 89-143). No further <br />reportable action was taken. <br /> <br />The Mayor and City Council returned to the Art Pick Council Chamber. <br /> <br />PUBLIC HEARINGS AND PLANNING REFERRALS AND APPEALS <br /> <br />CASE P03-0503 - APPEAL - MINOR CONDITIONAL USE PERMIT - <br />10789 HOLE - CONTINUED <br />Discussion was continued to December 2, 2003, relative to the appeal of <br />Administrative Planning Case P03-0503 by John Beke, Project Manager, <br />Nextel Communications, from the decision of the Zoning Administrator in <br />tentatively denying the request of Nextel Communications to construct a <br />wireless communications facility designed to resemble a palm tree and an <br />unmanned equipment enclosure on approximately 1.8 acres developed with a <br />mini-storage facility at 10789 Hole Avenue between Mitchell and Hedrick <br />Avenues, in Zone C-3-S-2. <br /> <br />CASE P03-0852 - REZONING - 3118 MADISON - ORD. INTRODUCED <br />Hearing was called on the proposal of the City of Riverside Redevelopment <br />Agency to place approximately .15 vacant acre at 3118 Madison Street <br />situated on the west side of Madison Street north of Peters Street, in Zone R- <br />1-65 from Zone C-3. No one was present wishing to speak on the matter. <br />No written protests were presented. Following discussion, the public hearing <br />was officially closed.
