1 HOLD HARMLESS AGREEMENT AND WAIVER OF LIABILITY <br /> 2 (7606 Freda Avenue) <br /> <br /> 3 THIS AGREEMENT is made and entered into this 10th day of AprJ_l ,1998, by and <br /> <br /> 4 between the REDEVELOPMENT AGENCY OF THE CITY OF RIVERSIDE, a public entity, <br /> 5 hereinafter referred to as "Agency," and DAVID L. AVILA, hereinafter referred to as "Property <br /> 6 Owner." <br /> 7 WITNESSETH: <br /> 8 WHEREAS, Property Owner applied to the Agency for a Housing Rehabilitation Loan to <br /> 9 replace the roof, make foundation repairs, install security screen doors, replace a window, make <br /> 10 water heater repairs, repair the air conditioning unit, make kitchen plumbing repairs and replace the <br /> 11 fixtures for a total project cost of Seven Thousand Seven Hundred Eight Dollars ($7,780); <br /> 12 WHEREAS, Agency granted approval for the Housing Rehabilitation Loan on November 4, <br /> 13 1997; <br /> 14 WHEREAS, Property Owner executed a promissory note and deed of trust in the amount of <br /> 15 $7,780 to the City of Riverside Development Department to fund the loan; <br /> 16 WHEREAS, the loan was funded and repairs were made to the property in December of 1997; <br /> 17 WHEREAS, problems with the concrete foundation of the property were discovered subsequent <br /> 18 to the rehabilitation work; <br /> 19 WHEREAS, Agency has retained Darrell L. Connerton and Schechtman Construction, Inc. to <br /> 20 inspect and repair the problem at an estimated cost of One Thousand Seven Hundred Eighty-five <br /> 21 Dollars ($1,785); <br /> 22 WHEREAS, Agency is willing to fund these repairs and Property Owner is willing to release <br /> 23 Agency from any and all liability for doing so; <br /> 24 NOW, THEREFORE, Agency and Property Owner agree as follows: <br /> 25 1.
