1 HOLD HARMLESS AGREEMENT AND WAIVER OF LIABILITY 2 (7606 Freda Avenue) 3 THIS AGREEMENT is made and entered into this 10th day of AprJ_l ,1998, by and 4 between the REDEVELOPMENT AGENCY OF THE CITY OF RIVERSIDE, a public entity, 5 hereinafter referred to as "Agency," and DAVID L. AVILA, hereinafter referred to as "Property 6 Owner." 7 WITNESSETH: 8 WHEREAS, Property Owner applied to the Agency for a Housing Rehabilitation Loan to 9 replace the roof, make foundation repairs, install security screen doors, replace a window, make 10 water heater repairs, repair the air conditioning unit, make kitchen plumbing repairs and replace the 11 fixtures for a total project cost of Seven Thousand Seven Hundred Eight Dollars ($7,780); 12 WHEREAS, Agency granted approval for the Housing Rehabilitation Loan on November 4, 13 1997; 14 WHEREAS, Property Owner executed a promissory note and deed of trust in the amount of 15 $7,780 to the City of Riverside Development Department to fund the loan; 16 WHEREAS, the loan was funded and repairs were made to the property in December of 1997; 17 WHEREAS, problems with the concrete foundation of the property were discovered subsequent 18 to the rehabilitation work; 19 WHEREAS, Agency has retained Darrell L. Connerton and Schechtman Construction, Inc. to 20 inspect and repair the problem at an estimated cost of One Thousand Seven Hundred Eighty-five 21 Dollars ($1,785); 22 WHEREAS, Agency is willing to fund these repairs and Property Owner is willing to release 23 Agency from any and all liability for doing so; 24 NOW, THEREFORE, Agency and Property Owner agree as follows: 25 1. In consideration for funding the inspection and repair as outlined above, Property Owner 26 hereby agrees to release, defend, indemnify, and hold the Agency as well as the City of Riverside 27 harmless from any and all losses, damages, claims for damages, liabilities, expenses or costs arising Attorney's Office Street 92522 782-5567
