W A T E R E N E R G Y L I F E <br />RIVERSIDE PUBLIC UTILITIES <br />• ' Board Memorandum <br />P U B L I C U T I L I T I E S <br />BOARD OF PUBLIC UTILITIES DATE: APRIL 27, 2020 <br />ITEM NO: 4 <br />SUBJECT: AMENDMENT NO. 5 TO THE OCTOBER 29, 2002, INTERIM AGREEMENT WTH <br />LOCKHEED MARTIN CORPORATION FOR THE REMOVAL OF PERCHLORATE <br />FROM WATER EXTRACTED FROM FOUR CITY OF RIVERSIDE WELLS <br />ISSUE: <br />Recommend that the City Council approve Amendment No. 5 to the October 29, 2002, Interim Agreement <br />between the City of Riverside and Lockheed Martin Corporation for the removal of perchlorate from water <br />extracted from four (4) City of Riverside wells. <br />RECOMMENDATIONS: <br />That the Board of Public Utilities recommend that the City Council: <br />1. Approve Amendment No. 5 to the October 29, 2002, Interim Agreement with Lockheed Martin <br />Corporation for the removal of perchlorate from water extracted from four (4) City of Riverside wells; <br />and <br />2. Authorize the City Manger, or designee, to execute Amendment No. 5 with Lockheed Martin, <br />including the ability to make non -substantial changes. <br />BACKGROUND: <br />Since 1998, Riverside Public Utilities (RPU) and Lockheed Martin Corporation (LMC) have worked <br />cooperatively toward remediation of trichloroethylene (TCE) and perchlorate from groundwater extracted <br />from RPU wells in the San Bernardino basin area. <br />On November 10, 1998, the City Council approved the Agreement with Lockheed Martin Coporation for <br />Remediation of Trichloroethylene (1998 TCE Agreement). <br />On October 22, 2002, the City Council approved an Interim Agreement with Lockheed Martin Coproration <br />for Removal of Perchlorate from Four Wells (2002 Interim Perchlorate Agreement). <br />On December 9, 2003, the City Council approved Amendment No. 1 to the 2002 Interim Perchlorate <br />Agreement. <br />On February 22, 2005, the City Council approved Amendment No. 2 to the 2002 Interim Perchlorate <br />Agreement. <br />On May 15, 2007, the City Council approved Amendment No. 3 to the 2002 Interim Perchlorate Agreement <br />and Amendment No. 1 to the 1998 TCE Agreement. <br />
