AM-001-956 <br /> <br /> 1 ORDINANCE NO. 6282 <br /> <br /> 2 AN ORDINANCE OF THE CITY OF RIVERSIDE, CALIFORNIA, <br /> AMENDING TITLE 19 OF THE RIVERSIDE MUNICIPAL CODE TO <br /> 3 PROVIDE FOR THE DISCONTINUANCE OF NONCONFORMING <br /> STATUS OF BUSINESSES WITH SALES OF ALCOHOLIC <br /> 4 BEVERAGES BY AMENDING SECTIONS 19.64.170, 19.64.290 <br /> AND 19.66.010; AND ADDING A NEW SECTION 19.66.045. <br /> 5 <br /> The City Council of the City of Riverside, California, <br /> 6 <br /> does ordain as follows: <br /> 7 <br /> Section 1: Section 19.64.170 of the Riverside Municipal <br /> 8 <br /> Code is hereby amended to add an exception to subsection (2) <br /> 9 <br /> thereof and to read as follows: <br /> 10 <br /> "19.64.170 VOIDING OF CONDITIONAL USE PERMITS OR <br /> 11 VARIANCES. Any conditional use permit granted by the <br /> Planning Commission or any variance granted by the Board <br /> 12 of Zoning Adjustment or any conditional use permit or <br /> variance granted by the City Council on appeal shall <br /> 13 become null and void if: <br /> <br /> 14 (1) The construction or use authorized by such <br /> permit or variance is not commenced within the <br /> 15 time limit specified in such permit or <br /> variance, and such construction is not pursued <br /> 16 diligently to completion; provided, however, <br /> that the Commission or Board may extend the <br /> 17 time limit if a written application showing <br /> good cause for such time extension is submitted <br /> 18 to the Planning Department prior to the <br /> expiration of the time limit; or <br /> 19 <br /> (2) The use for which the permit or variance was <br /> 20 granted has ceased to exist or has been <br /> suspended for six months or more, except that <br /> 21 permits for uses which involve the on or off- <br /> sale of alcoholic beverages shall be subject to <br /> 22 the provisions of Section 19.66.045 - <br /> Discontinuance of the Operation of a Business <br /> 23 which sells Alcoholic Beverages; or <br /> 24 (3) The owner or owner's authorized representative <br /> of the property for which the permit or <br /> 25 variance was granted requests in writing that <br /> the permit or variance be voided and the <br /> 26 Commission or Board having jurisdiction <br /> approved such request.
