W A T F R E N E R G Y L <br />RIVERSIDE PUBLIC UTILITIES <br />.�W& <br />Board Memorandum <br />P U B L I C U T I L I T I E S <br />BOARD OF PUBLIC UTILITIES DATE: AUGUST 27, 2018 <br />ITEM NO: 10 <br />SUBJECT: PROPERTY CONVEYANCE AGREEMENT WITH GUTHRIE PERICLES, LLC FOR THE <br />SALE OF A 6,194 SQUARE FOOT PORTION OF THE GAGE CANAL RESERVING <br />WATER RIGHTS AS WELL AS AN EASEMENT FOR WATERLINE AND CANAL <br />FACILITIES LOCATED ON MARLBOROUGH AVENUE IN THE AMOUNT OF $1,000 <br />AND ACCEPTANCE OF A GRANT OF EASEMENT FROM GUTHRIE PERICLES, LLC <br />FOR A PUBLIC STREET TO FACILITATE CONSTRUCTION OF A CUL-DE-SAC <br />ISSUE: <br />Recommend that the City Council approve the Property Conveyance Agreement with Guthrie Pericles, <br />LLC for the sale of a 6,194 square foot portion of the Gage Canal reserving all water rights as well an <br />easement for waterline and canal facilities located on Marlborough Avenue, bearing Assessor's Parcel <br />Number 257-060-015, in the amount of $1,000 and acceptance of a Grant of Easement from Guthrie <br />Pericles, LLC for a public streets to facilitate construction of a cul-de-sac. <br />RECOMMENDATIONS: <br />That the Board of Public Utilities recommend that the City Council: <br />1. Approve the Property Conveyance Agreement with Guthrie Pericles, LLC for the sale of a 6,194 <br />square foot portion of the Gage Canal reserving all water rights as well an easement for waterline <br />and canal facilities located on Marlborough Avenue, bearing Assessor's Parcel Number 257-060- <br />015, in the amount of $1,000; <br />2. Authorize acceptance of a Grant of Easement from Guthrie Pericles, LLC to the City conveying a <br />public street and highway easement for public right-of-way; and <br />3. Authorize the City Manager, or his designee, to execute the Property Conveyance Agreement, <br />including making minor non -substantive changes, and to sign all documents necessary to complete <br />the transaction. <br />BACKGROUND: <br />In 1999, Parcel Map No. 29161 was recorded depicting an 11 parcel subdivision at the southwest corner <br />of Columbia and Michigan Avenues. The Parcel Map was conditioned to dedicate right-of-way for the <br />termination of Marlborough Avenue, east of the Gage Canal. The right-of-way dedication was planned to <br />provide access to the parcel at the terminus of Marlborough Avenue; however, the cul-de-sac was never <br />constructed. <br />On June 26, 2018, the City Council upheld the decision of the Development Review Committee and <br />approved Planning Case P17-0506 (Design Review), P17-0507 (Grading Exception), P17-0748 (Grading <br />Exception), and P17-0749 (Variance) to facilitate development of the property east of the Marlborough <br />Avenue terminus with a 346,290 square foot industrial warehouse building. <br />Page 232 <br />
