1 ORDINANCE NO. 6277 <br /> 2 AN ORDINANCE OF THE CITY OF RIVERSIDE, CALIFORNIA, <br /> AMENDING TITLE 13 OF THE RIVERSIDE MI/NICIPAL CODE BY <br /> 3 ADDING SECTION 13.08.O25 REGULATING ENCROACHMENT <br /> PERMITS FOR PUBLIC PAY TELEPHONES LOCATED IN THE <br /> 4 PUBLIC RIGHT-OF-WAY OR UPON PUBLIC EASEMENT <br /> 5 <br /> The City Council of the City of Riverside, California, <br /> 6 <br /> does ordain as follows: <br /> 7 <br /> Section 1: Title 13 of the Riverside Municipal Code is <br /> 8 <br /> hereby amended by adding Section 13.08.025 setting forth the <br /> 9 <br /> standards for issuance of encroachment permits for construction <br /> 10 <br /> or placement of public pay telephones in the public street right- <br /> 11 <br /> of-way or upon any city-owned easement, which added section shall <br /> 12 <br /> read as follows: <br /> 13 <br /> " 13.08.025 STANDARDS FOR PAY TELEPHONES PLACED IN THE <br /> 14 PUBLIC RIGHT-OF-WAY OR UPON CITY-OWNED EASEMENT. <br /> <br /> 15 Any pay telephone installed or placed upon or projecting <br /> over a street right-of-way or upon any city-owned easement in <br /> 16 whole or in part, shall be in compliance with the standards set <br /> forth in this section. An encroachment permit pursuant to <br /> 17 Section 13.08.015 shall not be issued unless all standards set <br /> forth below have been satisfied. <br /> 18 <br /> (a) No encroachment permits will be issued for pay <br /> 19 telephones for residential neighborhood locations. <br /> 20 (b) No encroachment permits will be issued for pay <br /> telephones which are planned to be placed or otherwise installed <br /> 21 or maintained within 200 feet of an existing pay telephone or <br /> cluster of pay telephones. A "cluster" means "group", or "two or <br /> 22 more" pay telephones. An encroachment application for a pay <br /> telephone permit must be accompanied with a map of other pay <br /> 23 telephones located within 200 feet of the proposed location. <br /> 24 (c) Each proposed location must have on-street parking <br /> available. <br /> 25 <br /> (d) Upon receipt for application for an encroachment <br /> 26 permit for a pay telephone, the Public Works Director or his <br /> designee shall forward a copy thereof for review to the Police <br /> 27 Department, Planning Department, Public Utilities Department- <br /> <br />Attorney's Office <br />Street <br />CA 92522 <br />782-5567 <br /> F: \WPDATA\ORD\ 95121406.
