CORRECTED AM-009-945 1 ORDINANCE NO. 6209 2 AN ORDINANCE OF THE CITY OF RIVERSIDE, CALIFORNIA, AMENDING TITLE 19 OF THE RIVERSIDE MUNICIPAL CODE BY 3 ADDING THERETO A NEW SECTION 19.04.411 PROVIDING A DEFINITION OF "PLANT NURSERY". 4 The City Council of the City of Riverside, California, 5 does ordain as follows: 6 Section 1: Chapter 19.04 of the Riverside Municipal Code 7 is hereby amended by adding thereto a new section 19.04.411 8 providing a definition of "plant nursery" to read as follows: 9 "19.04.411 PLANT NURSERY. "Plant nursery" 10 means any site or facility where nursery plants and related gardening materials and supplies are 11 sold within a defined, approved, physically enclosed area. Such enclosure may include a 12 combination of solid walls and open work fencing and must effectively screen the plants and 13 nursery supplies from the surrounding area subject to approval of the Design Review Board. 14 If incidental to a larger retail use, a plant nursery must be adjacent to the primary building 15 or have a direct architectural relationship to the building. Plant nurseries are not permitted 16 to sell materials and supplies within designated parking and walkway areas except with a valid 17 Temporary Use Permit, per Section 19.69.020, for the outdoor sale of merchandise. (Code Section 18 19.69.020)." 19 Section 2: The City Clerk shall certify to the adoption 20 of this ordinance and cause publication once in a newspaper of 21 general circulation in accordance with Section 414 of the Charter 22 of the City of Riverside.
