CLOSED SESSIONS The Mayor and City Council recessed to the City Council Board Room for closed sessions pursuant to Government Code §54956.9 to confer with and/or receive advice from legal counsel concerning (1) Jay Theuer, et al. v. City of Riverside - United States District Court Case No. ED CV00-4495; and (2) one case of anticipated litigation. The City Attorney announced there was no reportable action on the closed sessions. RECESS The City Council recessed at 2:15 p.m. and reconvened at 3:05 p.m. with all Councilmembers present except Councilmember Pearson. PUBLIC HEARINGS AND PLANNING REFERRALS AND APPEALS CASE GP-009-012 - 5100 QUAIL RUN Hearing was called on the proposal of Albert A. Webb Associates, on behalf of Spanos Corporation, to amend the General Plan land use designation of approximately 18.6 acres partially developed with the Riverside County Sheriff's Training Facility from Zones PFI and RMH to Zone RHD at 5100 Quail Run Road, situated southwesterly of Quail Run Road between Sycamore Canyon Boulevard and Central Avenue. No one was present wishing to speak on the matter. No written protests were presented. The public hearing was officially closed. The City Council (1) upheld the action of the Planning Commission in approving Case GP-009-012 with modifications and subject to conditions; (2) adopted the staff report and environmental assessment as findings; (3) upheld the Planning Commission's determination that the project would not have a significant effect on the environment and concurred in the adoption of a Mitigated Negative Declaration; (4) found that the proposed project could have the potential for adverse effect on wildlife resources and the applicant is responsible for payment of Fish and Game fees at the time the Notice of Determination is filed with the County; and (5) requested the City Attorney to prepare the appropriate resolution for adoption within thirty days. ZONING CASE RZ-021-012 5100 QUAIL RUN ORDINANCE INTRODUCED Hearing was called on the proposal of Albert A. Webb Associates, on behalf of Spanos Corporation, to place approximately 18.6 acres partially developed with the Riverside County Sheriff's Training Facility at 5100 Quail Run Road, situated southwesterly of Quail Run Road between Sycamore Canyon 88-298 Present Motion Second All Ayes
