AM-014-967 <br /> <br /> 1 ORDINANCE NO. 6351 <br /> <br /> 2 AN ORDINANCE OF THE CITY OF RIVERSIDE, CALIFORNIA, <br /> AMENDING SECTIONS 19.26.020(8), 19.26.020(2)K., <br /> 3 19.28.020(13), 19.30.020(23) AND 19.32.020(21) OF <br /> TITLE 19 OF THE RIVERSIDE MUNICIPAL CODE TO ALLOW <br /> 4 INCIDENTAL ALCOHOL SALES OF WINE WITH FLORAL OR GIFT <br /> BASKETS AT FLORIST SHOPS SUBJECT TO THE GRANTING OF <br /> 5 A MINOR CONDITIONAL USE PERMIT. <br /> 6 The City Council of the City of Riverside, California, <br /> 7 does ordain as follows: <br /> 8 Section 1: Section 19.26.020(8) of the Riverside <br /> 9 Municipal Code is hereby amended to read as follows: <br /> 10 "(8) Off-sale of all alcoholic beverages subject to a <br /> conditional use permit and the site location criteria and <br /> 11 development standards listed below. However, the <br /> requirement for a conditional use permit shall not apply <br /> 12 to establishments containing 15,000 square feet or more <br /> of the gross floor area which do not sell alcoholic <br /> 13 beverages as their principal business. Additionally, <br /> florist shops which propose the incidental sale of wine <br /> 14 with gift or floral baskets shall obtain a minor <br /> conditional use permit subject to operational standards <br /> 15 set out in Section 19.26.020(2)K." <br /> 16 Section 2: Section 19.26.020(2)K. of the Riverside <br /> 17 Municipal Code is hereby amended to read as follows: <br /> 18 "K. Florist shop, except that incidental off-site sale <br /> of wine may be permitted subject to the granting of a <br /> 19 minor conditional use permit according to the following <br /> operating standards. <br /> 20 <br /> 1. Operation Standards. <br /> 21 <br /> a. The sale of wine shall be clearly incidental to <br /> 22 a florist shop business, and shall not exceed 5% of the <br /> annual gross sales revenue of the florist business. <br /> 23 <br /> b. The sale of wine shall be limited to gift or <br /> 24 floral arrangements. Individual containers of wine not <br /> packaged as part of such arrangements may not be sold. <br /> 25 <br /> c. No beer or distilled spirits may be sold. <br /> 26 <br /> 2. Variances.
