1 ORDINANCE NO. 634] <br /> 2 AN ORDINANCE OF THE CITY OF RIVERSIDE, CALIFORNIA, <br /> REPEALING CHAPTERS 1.15 AND 1.16 OF THE RIVERSIDE <br /> 3 MUNICIPAL CODE AND ADDING CHAPTER 1.15 OF THE <br /> RIVERSIDE MUNICIPAL CODE, AND ADDING SECTION <br />4 1.15.030 - PREPARATION AND FORM OF CANDIDATE <br /> STATEMENTS. <br />5 <br />6 The City Council of the City of Riverside, California, <br />7 does ordain as follows: <br />8 WHEREAS Chapter 1.15 "Nomination Periods" and Chapter <br />9 1.16 "Elections" of the Riverside Municipal Code both pertain to <br />10 elections of the City of Riverside and it would be more expedient <br />11 to have a single chapter pertaining to elections; and <br />12 WHEREAS Section 1.15.010 is entitled "Establishment", and <br />13 said title should for purposes of accuracy be entitled <br />14 "Nomination Periods"; and <br />15 WHEREAS Section 1.16.010 "Mail-in Ballot Elections" <br />16 should be recodified as Section 1.15.020 "Mail-in Ballot <br />17 Elections"; and <br />18 WHEREAS free and honest elections are the very foundation <br />19 of our republican form of government; and <br />20 WHEREAS Section 13307 of the Elections Code of the State <br />21 of California permits a candidate for nonpartisan elective office <br />22 in any local agency to prepare and submit a candidate's statement <br />23 which may include the name, age, occupation, education and <br />24 qualifications expressed by the candidate himself or herself; and <br />25 WHEREAS the California State Supreme Court in Clark v. <br />26 Burleiqh 4 Cal.4th. 474; 14 Cal.Rptr. 2d 455 (1992) determined <br />27 that the Legislature did not intend the statutory candidate's <br />Attorney's Office <br />Street <br />CA 92522 <br />782-5567 <br /> F:~WPDATA~ORD~96173901.SY <br /> <br /> <br />
