1 <br /> 2 <br /> 3 <br /> 4 <br /> 5 <br /> 6 <br /> 7 <br /> 8 <br /> 9 <br /> 10 <br /> 11 <br /> 12 <br /> 13 <br /> 14 <br /> 15 <br /> 16 <br /> 17 <br /> 18 <br /> 19 <br /> 20 <br /> 21 <br /> 22 <br /> 23 <br /> 24 <br /> 25 <br /> 26 <br /> 27 <br /> <br />City Attorney's Office <br />3900 Main Street <br />Riverside, CA 92522 <br />(909) 826-5567 <br /> <br />RESOLUTION NO. 704 <br /> <br />A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF <br />RIVERSIDE, CALIFORNIA, FINDING AND DETERMINING THE PUBLIC <br />INTEREST AND NECESSITY FOR ACQUIRING AND AUTHORIZING THE <br />CONDEMNATION OF CERTAIN INTERESTS IN CERTAIN REAL PROPERTY <br />LOCATED WITHIN THE MAGNOLIA CENTER REDEVELOPMENT PROJECT <br />AREA <br /> <br /> WHEREAS, the Agency Secretary for the Redevelopment Agency of the City of Riverside <br />("Agency") duly noticed the Agency's intention to adopt a Resolution of Necessity pursuant to <br />California Code of Civil Procedure section 1245.235 for the purpose of acquiring certain interests <br />in real property by eminent domain for the Riverside Plaza Redevelopment Project ("Project"); <br />and <br /> <br /> WHEREAS, a public hearing was held by the Agency on November 12, 2002, at the time <br />and place stated in the Notice of Intention to Adopt Resolution of Necessity, at which time the <br />Agency duly considered the matters to be heard; and <br /> <br /> NOW, THEREFORE, BE IT FOUND, RESOLVED, DETERMINED AND ORDERED by <br />the Redevelopment Agency for the City of Riverside, California, by a vote of not less than two- <br />thirds of its members, as follows: <br /> <br /> 1. The real property interests sought to be acquired are located within the Magnolia <br />Center Redevelopment Project area in the City and County of Riverside, State of California and <br />are legally described in the attached Exhibit "A". The interest to be acquired herein is a leased fee. <br />Parcel maps depicting the general location and dimensions of the interests to be acquired are <br />attached hereto as Exhibit "B". Exhibits "A" and "B" are incorporated herein by this reference <br />("Subject Property"). <br /> <br /> 2. The Agency is authorized to acquire the Subject Property by exercise of the right of <br />eminent domain pursuant to the California Redevelopment Law (Part 1 of Division 24, Health and <br />Safety Code) including without limitation, Health and Safety Code section 33391(b); The Eminent <br />Domain Law, commencing with California Code of Civil Procedure section 1235.010; Article I <br />Section 19 of the Constitution of the State of California; and the United States Constitution. <br /> <br /> <br />
