1 RESOLUTION NO. 18839 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RIVERSIDE, CALIFORNIA, MAKING ITS FINDINGS AS 3 REQUIRED BY SECTION 17958.7 OF THE HEALTH AND SAFETY CODE OF THE STATE OF CALIFORNIA RELATING 4 TO THE AMENDMENT OF SECTION 904.2 OF THE 1994 EDITION OF THE UNIFORM BUILDING CODE. 5 6 WHEREAS Section 17958 of the Health and Safety Code of the 7 State of California provides that if a city does not amend, add, or 8 repeal ordinances or regulations to impose the same requirements as 9 are contained in the provisions adopted pursuant to Section 17922 10 of said Health and Safety Code and published in the State 11 [California] Building Standards Code and the other regulations 12 adopted pursuant to Section 17922 or make changes or modifications 13 in those requirements upon express findings, the provisions 14 published in the State [California] Building Standards Code or 15 other regulations promulgated pursuant to Section 17922 shall be 16 applicable to it and shall become effective 180 days after 17 publication by the State Building Standards Commission; and 18 WHEREAS Section 17922(b) of the Health and Safety Code 19 provides that local use zone requirements, local fire zones, 20 building setbacks, side and rear yard requirements, and property 21 line requirements are specifically and entirely reserved to the 22 local jurisdiction except as provided in Section 17959.5 of the 23 Health and Safety Code; and 24 WHEREAS Section 17958.5 of the Health and Safety Code of 25 the State of California provides that in adopting ordinances or 26 regulations making any changes in the provisions in the California 27 Building Standards Code and other regulations adopted pursuant to Attorney's Office ~re~ CA 92522 782-5567 F:\WPDATA~RES~95242301.BP
