1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />Cm ATTo1C MOFFxE <br />3900 MAN S ET <br />Fbva jm0 CA 925n <br />(951) 8I6-SM7 <br />RESOLUTION NO. 2009-03 <br />A RESOLUTION OF THE BOARD OF PUBLIC UTILITIES OF THE CITY OF <br />RIVERSIDE, CALIFORNIA (1) ADOPTING REVISED ELECTRIC RULES 1, <br />2, 6, 11, 15, 21, WATER RULES 1, 2, 6, 17, EFFECTIVE UPON APPROVAL; <br />(2) ADOPTING ELECTRIC RATE SCHEDULE PA- POWER -- <br />AGRICULTURAL PUMPING, EFFECTIVE UPON APPROVAL; (3) <br />ADOPTING ELECTRIC RATE SCHEDULE PA-POWER—AGRICULTURAL <br />PUMPING, EFFECTIVE JANUARY 1, 2010; (4) MAKING FINDINGS OF <br />FACT; AND (5) RECOMMENDING CITY COUNCIL APPROVAL THEREOF <br />WHEREAS, the City of Riverside's ("City") Department of Public Utilities ("RPU") has <br />submitted for action by the Board of Public Utilities (`Board") and the City Council, the <br />proposed adoption and approval of revised Electric Rules 1, 2, 6, 11, 15, 21, Water Rules 1, 2, 6, <br />17; Electric Rate Schedule PA- Power — Agricultural Pumping, (effective upon approval); and <br />Electric Rate Schedule PA - Power—Agricultural Pumping (effective January 1, 2010); and <br />WHEREAS, the City's Electric Utility provides service to over 105,000 metered electric <br />customers pursuant to its Electric Rules and Rate Tariffs; and <br />WHEREAS, the City's Water Utility provides service to over 63,000 metered water <br />customers pursuant to the Water Rules and Rate Tariffs; and <br />WHEREAS, Staff is recommending certain changes to the Electric Rate Tariffs and the <br />Electric and Water Rules; and <br />WHEREAS, the City's municipal code provides that all claims for money damages must <br />be presented to the City within one year (Riverside Municipal Code chapter 1.05); and <br />WHEREAS, the Electric Rule and Water Rule 6 conflict with this requirement, and allow <br />the Utility to credit or bill customers for up to three years in cases of both overcharges and <br />undercharges; and <br />WHEREAS, this creates revenue instability in cases where customers were on one rate <br />that was more beneficial to them, but due to rate increases or restructuring of rates tariffs (tiers, <br />seasons, reliability charges, etc.,) their current rate is less beneficial than another rate tariff.
