1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />I3 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />Cm' AtlaRNEY's 4rMl <br />DIN NIASNSTRCEr <br />R[vm mf CA 92522 <br />(95 1) 826-5567 <br />i:7;kill Roil I����>i�[��►�IMI�I;Isi>il <br />A RESOLUTION OF THE BOARD OF PUBLIC UTILITIES OF THE CITY <br />OF RIVERSIDE, CALIFORNIA, RECORDING RECEIPT OF WRITTEN <br />PROTESTS, COMMENTS OR OBJECTIONS TO WATER RATE <br />ADJUSTMENTS APPROVED BY CITY COUNCIL RESOLUTION 21148 <br />AND RE -AFFIRMING SUCH RATE ADJUSTMENTS <br />WHEREAS, on March 28, 2006, the City of Riverside adopted Resolution No. 21148, <br />effective November 1, 2006, 2007, 2008, 2009 and 2010, approving annual rate adjustments for <br />water service over a five year period, including all appropriate findings of fact thereto; and <br />WHEREAS, beginning on April 2, 2008 through May 1, 2008, the City mailed written <br />notices to all record owners directly liable to pay such rates, including both property owners and <br />ratepayers, of the City's intent to hold a public hearing to re -affirm such water rates; and <br />WHEREAS, such notice provided that the bases and reasons for these adjustments are to <br />enable the City, through its Public Utilities Department, to recover increasing operating expenses, <br />improve and expand water service, and provide additional capital needs required to operate the <br />Water Utility in a financially prudent manner; and <br />WHEREAS, the notice further provided that at the time of the public hearing, the Board of <br />Public Utilities will hear and consider all written comments, protests and objections concerning these <br />matters and will consider and may reaffirm the specified rates. <br />WHEREAS, a copy of the text of such notice is attached hereto as Exhibit A; and <br />WHEREAS, on June 20, 2008, at 8:30 a.m., at the Public Utilities Boardroom, located at <br />3901 Orange Street, Riverside, the Board of Public Utilities conducted a public hearing on the <br />proposed affirmation of the increases; and <br />WHEREAS, at the time of the public hearing, 60 written comments, protests and/or <br />objections concerning these matters were received. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Riverside, <br />California, as follows: <br />Section 1: That a majority of the record owners directly liable to pay such rates, including <br />
