I RESOLUTION NO. 97- 4 <br />2 A RESOLUTION OF THE BOARD OF PUBLIC UTILITIES OF THE CITY OF <br />RIVERSIDE, CALIFORNIA, RECOMMENDING APPROVAL BY THE CITY <br />3 COUNCIL OF THE PUBLIC BENEFITS CHARGE OF 2.85% OF TOTAL ELECTRIC <br />USAGE CHARGES ON LOCAL DISTRIBUTION SERVICE, AS REQUIRED BY <br />4 A.B. 1890. <br />5 WHEREAS, the Legislature of the State of California has enacted legislation providing for <br />6 the restructuring of the electrical industry in California ("A.B. 1890"); and <br />7 WHEREAS, A.B. 1890 provides that each local publicly owned electric utility shall establish <br />8 a nonbypassable, usage based charge on local distribution service tied to the lowest percentage spent <br />9 by California's three largest investor owned utilities to fund investments by the utility in certain public <br />10 benefit programs ("public benefits charge"); and <br />11 WHEREAS, California Energy Commission data establishes that the lowest percentage <br />12 spent by California's three Iargest investor owned utilities on the public benefit programs is 2.85%, and <br />13 therefore the minimum public benefits charge is 2.85%; and <br />14 WHEREAS, the Public Utilities of Riverside is a local publicly owned electric utility <br />15 mandated under A.B. 1890 to levy a public benefits charge of at least 2.85%; and <br />16 WHEREAS, the Public Utilities of Riverside has the discretion to establish the public <br />17 benefits charge at a rate in excess of the mandated minimum of 2.85%; and <br />18 WHEREAS, under Section 1202 of the City Charter, the Board of Public Utilities has the <br />19 power and duty to establish rates for the electric utility in the City; and <br />20 WHEREAS, a public hearing, notice of which was published in the Press -Enterprise on <br />21 November 6 and 13, 1997, was commenced by the Board on November 21, 1997 to receive and <br />22 consider oral and written comments from the public on the amount of the public benefits charge, and <br />23 after receipt and consideration thereof the Board concluded the hearing; and <br />24 WHEREAS, the Board intends to limit the public benefits charge to 2.85% of total electricity <br />25 usage charges on local distribution services; <br />26 NOW THEREFORE, BE IT RESOLVED by the Board of Public Utilities of the City of <br />27 Riverside, California, as follows: <br />Cityty Attorney's Mee <br />39ti0 Main Street <br />Riverside, CA 92522 <br />(909)782-5567 <br />-1- <br />
