COMER AND HOLLY LYN COMER, husband and wife as joint tenants <br /> as to an undivided one-half interest, and CHRISTIAN E. SINGLETARY AND RU ANNA <br /> SINGLETARY, husband and wife as to an undivided one-half interest (collectively, "Buyer"). <br /> <br /> RECITALS <br /> <br /> A. Seller owns certain real property located at 8856 Arlington Avenue (Assessor Parcel No. <br />151-061-003) and 8855 Philip Avenue (Assessor Parcel No. 151-061-006) in the City of Riverside, <br />County of Riverside, State of California, more particularly described as Lot 286 of Camp Anza <br />Subdivision Number 1, as shown by Map on file in Map Book 22, Pages 81 and 82 thereof, records <br />of Riverside County, California (the "Property"). <br /> <br /> B. Buyer has entered into an Agreement of Purchase and Sale and Escrow Instructions with <br />Seller, dated October 5, 2001, for the purchase of the Property. <br /> <br /> C. Seller has previously undertaken and caused to be performed certain remediation work <br />on the Property to remove hazardous material, as referenced in the County of Riverside letter, dated <br />November 13, 2001, confirming the completion of the clean-up ("November 13, 2001 letter"). A <br />true and correct copy of the November 13, 2001 letter is attached hereto as Exhibit A. <br /> <br /> D. To complete the sale of the Property, Buyer has requested that the Seller hold Buyer <br />harmless from any costs associated with the remediation of the Property referenced in the November <br />13, 2001 letter. <br /> <br /> NOW, THEREFORE, in consideration of the foregoing, Seller and Buyer agree as follows: <br /> <br /> 1.
