11� <br />CITY OF <br />IZIVER.SIDE <br />City ?f Arts &Innovation <br />City Council Memorandum <br />TO: HONORABLE MAYOR AND CITY COUNCIL DATE: MARCH 14, 2017 <br />FROM: CHAMPAGNE FORD, CHAIR WARDS: ALL <br />BOARD OF ETHICS HEARING PANEL <br />SUBJECT: REQUEST FOR CLOSED SESSION AUDIO <br />ISSUE: <br />The Board of Ethics Hearing Panel in the matter of the Code of Ethics and Conduct complaint <br />filed on December 27, 2016, by Jason Hunter against Councilmember Andy Melendrez requests <br />the City Council consider waiving closed session privileges pursuant to California Government <br />Code Sections 54956.9 and 54963 and release to the Hearing Panel the recording of the closed <br />session occurring on July 22, 2014. <br />RECOMMENDATION: <br />That the City Council consider the request by the Board of Ethics Hearing Panel to (1) waive <br />closed session privileges pursuant to California Government Code Sections 54956.9 and 54963; <br />and (2) direct the City Clerk to release the recording of the closed session occurring on July 22, <br />2014, to the Hearing Panel. <br />BACKGROUND /LEGISLATIVE HISTORY: <br />On February 10, 2017, the Board of Ethics Hearing Panel in the matter of the Code of Ethics <br />and Conduct complaint filed on December 27, 2016, by Jason Hunter against Councilmember <br />Andy Melendrez unanimously approved a request be made to the City Council to waive closed <br />session privileges pursuant to California Government Code Sections 54956.9 and 54963 and <br />release to the Hearing Panel the recording of the closed session occurring on July 22, 2014. <br />The City's Records Retention Schedule provides for destruction of City Council closed session <br />audio and minutes after two years. In compliance with the City's Records Retention Schedule, <br />the July 22, 2014, City Council closed session audio, minutes, and any supporting <br />documentation were destroyed. <br />FISCAL IMPACT: <br />There is no fiscal impact associated with this report. <br />
