CITY OF-',IVERSIDE <br />CITY COUNCIL <br /> <br />COU~,~CILMEMBERS <br /> <br />Minutes of: <br />Time of Meeting: <br />Place of Meeting: <br />Date of Meeting: <br /> <br />Regular Meeting of the City Council <br />3p.m. <br />Art Pick Council Chamber, City Hall <br />October 9, 2001 <br /> <br />WARDS <br /> <br />Roll Call: <br /> <br />PUBLIC HEARINGS AND PLANNING REFERRALS AND APPEALS <br /> <br />CASE VR-119-001 - APPEAL - 10129 JULIAN - CONTINUED <br />At the request of the Planning Director, the City Council continued to 3 p.m. <br />on January 8, 2002, discussion relative to the appeal of Variance Case VR- <br />119-001 by Surinder Khullar, from the decision of the Zoning Administrator, in <br />denying his request to legalize an existing block wall and tubular steel fence <br />with elements up to six feet in height in the front yard setback along Julian <br />Drive where a maximum four-foot-high fence is permitted at 10129 Julian <br />Drive, in Zone R-1-65. The fence also extends along Idyllwild Drive where a <br />six-foot fence is permitted in the side yard setback. <br /> <br />ZONING CASE CU-006-012 - 4773 TYLER <br />3 P.M--Hearing was called on the proposal of Munir Hawara, on behalf of <br />Tyler Market, for a conditional use permit to upgrade the existing alcohol <br />beverage license from off-sale beer and wine to off-sale general alcohol sales <br />at 4773 Tyler Street located at the southeasterly corner of Tyler Street and <br />Wells Avenue, in Zone C-2. In conjunction with conditional use permits, the <br />City Council is authorized to grant variances to the Zoning Ordinance as <br />deemed appropriate. The applicant's representative spoke regarding the <br />project. One oral protest was presented and considered. No written protests <br />were presented. Following discussion, the public hearing was officially <br />closed. Motion was made and seconded to deny Zoning Case CU-006-012. <br /> <br />Following further discussion, a substitute motion was made to (1) approve <br />Zoning Case CU-006-012 with modifications and subject to conditions and <br />adding a condition that strict adherence to the Sign Code will be enforced <br />and lack of compliance will be grounds for revocation; (2) adopted the staff <br />report and environmental assessment as findings; (3) upheld the <br />Commission's determination that the project will not have a significant <br />effect on the environment and concurred in the adoption of a Mitigated <br />Negative Declaration; and (4) found there is no evidence that the <br />proposed project will have any potential for adverse effect on wildlife <br />resources and the impacts of the project are found to be de minimis <br />pursuant to Section 711.4 of the Fish and Game Code. <br /> <br />CASE VR-158-001 - APPEAL - 7171 BODEWIN <br />Discussion was held relative to the appeal of Variance Case VR-158-001 by <br />Wayne Ewing, Krieger & Stewart, on behalf of Kaustubh Patankar, from the <br />decision of the Planning Commission in denying his proposal to construct an <br />approximately 7,750-square-foot residence with a 1,184-square-foot attached <br />garage at 7171 Bodewin Court in Zone RC.
