<br /> CASE VAC-10-823 - PORTION OF OCOTILLO DRIVE RIGHT OF WAY - APPROVED
<br />~3:00 P.M.--Hearing was called on Resolution No. 14910, adopted February 22, 1983, for
<br />~the proposed vacation of a portion of Ocotillo Drive right of way, located at the
<br />~easterly term/nus of Ocotillo Drive, Case VAC-10-823. As heretofore directed by the
<br />~City Council, the minutes of the City Planning Commission and the Environmental Protec-
<br />triot Commission pertaining to this matter are on file and are a part of the evidence
<br />~submitted at this hearing, whether or not any portion thereof is read or discussed.
<br />~The communication from the City Planning Commission stated that the Commission, by a
<br />~vote of 9 ayes to 0 noes, approved the vacation subject to the following conditions:
<br />[(t) This vacation shall be by ordinance or as otherwise approved by the Legal Depart-
<br />~ment; (2) The Legal Department shall determine which, if any, nearby property owners
<br />~will be significantly affected by the vacation action and the applicant shall provide
<br />~the appropriate hold harmless documents to the specifications of the Public Works
<br />~Department; (3) All utilities shall be satisfactorily reiDcared, protected and/or
<br />~replaced to the specifications of the affected departments and agencies, and easements
<br />'for such facilities retained as necessary; and (4) The adoption of the vacation shall
<br />=be concurrent with the adoption of Tract 9006-I. The communication from the Environ-
<br />~men=al Protection Commission advised thai =he Commission, by a vote of 7 ayes to
<br />:0 noes, determined that the proposed vacation would not have a significant adverse
<br />,an ~r nmental effect. The Planning Director pm~sented departmental recommendations,
<br />'to ether with maps of the area. one was

<br />,No written protests were presented. The hearing was officially closed. The vacation
<br />,was approved subject to the recommended conditions; it was determined that the proposed
<br />~ cation would not have a significant adverse environmental effect; and the staff

<br />[of =he City Council of the City of Riverside, California, Making Its Findings and

<br />:Public Convenience and Necessity Require the Reservation of Such Easement; and ~king
<br />:Its Order Vacating a Portion of Ocotillo Drive Right of Way, was presented; and ~he
<br />,title having been read, and further reading waived by the unanimous consent of Council- Motion
<br />,members present, was adopted; and the City Clerk was instructed that the resolution of Second

<br />'the proposed vacation of a public utility and road easement located southeasterly of
<br />{the terminus of Gainsborough Drive, Case VAC-11-823. As heretofore directed by the
<br />~City Council, the minutes of the City Planning Commission and the Environmental Protec-
<br />triot Commission pertaining to this matter are on file and are a part of the evidence
<br />~submit~ed at this hearing, whether or not any portion thereof is read or discussed.
