<br /> ~ZONING CASE R-30-834 - CENTRAL ADJACENT TO AT&SF RAILROAD - REZONING - ORDINANCE
<br /> ~ INTRODUCED
<br /> ~3:00 P.M.--Hearing was called on the proposal of Riverside M~numental Co., Zoning Case
<br /> ~R-30-834, to place the approximately .64 acre of vacant land situated on the north
<br /> ~side of Central Avenue ad3acent on the west to the Atchison, Topeka and Santa Fe
<br /> ~Railroad, westerly of Olivewood Cemetery, in Zone C-3 and remove the same from Zone
<br /> ~R-1-80; with the City Council to also consider supplementing the requested zoning with
<br /> ~Zones S and X. As heretofore directed by the City Council, the minutes of the City
<br /> ~Planning Com~uLssion pertaining to this case are on file and are a part of the evidence
<br /> =submitted at this hearing, whether or not any portion thereof is read or discussed.
<br /> ~The communication from the City Planning Commission stated that the Commission, by a
<br /> ,vote of 8 ayes to 0 noes, approved Zones C-3-S-i on the northerly 133 feet and Zones
<br /> RO-S-1 on the remainder, subject to the following conditions: (1) There shall be a
<br /> two-year time limit in which to satisfy the following conditions and finalize this
<br /> action. If the zoning is not adopted within two years of the date of introduction of
<br /> the ordinance, the action taken on this petition shall be void. A time extension of
<br /> not more than one year may be requested of the City Council by letter. Such time
<br /> extension request must be received by the City Clerk 30 days prior to the end of the
<br /> two-year limit; (2) The provision of public utility easements, water, street lights
<br /> and electrical underground and/or overhead facilities and fees in accordance with the
<br /> rules and regulations of the Public Utilities Department; (3) By covenant executed
<br /> concurrently with adoption of the rezoning, the applicant shall agree to limit signing
<br /> of the entire sine to that allowed in Zone RO; (4) Zones RO-S-1 (Restricted Office and
<br /> Single-Story Height of Buildings Combining Zones) shall apply to the entire site
<br /> except for the most northerly 133 feet which shall be in Zones C-3-S-I (General Commer-
<br /> cial and Single-Story Height of Buildings Combining Zones); (5) Installation of a
<br /> Class 2 bikeway on Central Avenue to Public Works Department specifications; (6) A
<br /> ~surety prepared by the Public Works Department to be posted to guarantee the required
<br /> off-site improvements prior to the final adoption of this zoning case; (7) Installation
<br /> ;of six-foot-high chain link fence along the Atchison, Topeka and Santa Fe Railroad
<br /> ;right-of-way; and (8) Size, number and location of driveways per plot plan approval
<br /> and to Public Works Department specifications; determined that the proposed rezoning
<br /> ;would not have a significant adverse environmental effect; and adopted the staff
<br /> ,report and the environmental assessment as findings. The Planning Director presented
<br /> ,maps of the area, and a clarification of the conditions that a covenant shall reflect
<br /> ,that contractor offices within the RO-zoned portion and contractor storage within the
<br /> &C-3-zoned portion would be the limit of the use, except for similar low-intensity of-
<br /> 'lice uses in the RO zone. No one was present wishing to speak on the matter. One wri~
<br /> ,ten protest was presented and considered. Following discussion, the hearing was offi-
<br /> ,cially closed. Zones C-3-S-t were approved on the northerly 133 feet and Zones RO-S-1
<br /> on The remainder, subject to the recommended conditions as clarified by the Flanning
<br /> Director; it was determined that the rezoning would not have a significant adverse Motion
