As heretofore directed by the City Council, the minutes of the City Planning <br />Commission and the Environmental Protection Co--~ission pertaining to this case are on <br />file and are a part of the evidence submitted at this hearing, whether or not any <br />~portion thereof is read or discussed. The co~mmnication from the City Planning <br />~Commission stated that the Go--~ission, by a vote of 7 ayes to 0 noes, approved the <br />~Very Low Density Residential-A land use designation (average 1.5 dwelling units per <br />,acre), subject to the condition that the Legal Department be requested to prepare, <br />~within 30 days of the date of approval of this case, the necessary resolution for City <br />,Council adoption to amend the General Plan Land Use Element. The co~unication from <br />the Environmental Protection Commission advised that the Com~.ission, by a vote of <br /> 6 ayes to 0 noes, determined that approval of the Very Low Density Residential-A <br /> land use designation would not have a significant adverse effect on the environment. <br /> The Planning Director presented departmental recomaendations, together with maps of <br /> the area. No protests, written or oral, were presented. The hearing was officially <br /> closed. It was determined that the General Plan amendment would not have a signifi- <br /> cant adverse environmental effect; and the staff report and the environmental assess- <br /> ment were adopted as findings. The proposed General Plan amendment was approved, <br /> removing the subject property from the Very Low Density Residential-B land use <br /> designation and placing it in the Very Low Density Residential-A land use designation <br /> and the City Attorney was requested to prepare the appropriate resolution for <br /> adoption within 30 days. <br /> <br /> FURTHER HEARING - ZONING CASE R-31-845 - 3659 CENTRAL AVENUE - APPEAL GRANTED - <br /> 0RDINANCE INTRODUCED <br />3:00 P.M.--Further hearing was called on the appeal of P. D. Lippert, Real Estate <br />~Representative, ARC0 Petroleum Products Company, relative to the conditions of ap- <br />:proval of the City Planning Commission regarding their request to place the approxi- <br />imately .6 acre of land, developed with a service station, located at 3659 Central <br />~Avenue, situated on the northeast corner of Central and De Anza Avenues, in Zone C-3 <br />:and remove the same from Zone C-4; with the City Council to also consider supplement- <br />~ing the requested zoning with Zones S and X, Zoning Case R-31-845. The hearing had <br />~been continued from December 4, 1984, and January 8, 1985, at the request of the <br />:appellant. As heretofore directed by the City Council, the minutes of the City <br />~Planning Commission pertaining to this case are on file and are a part of the evidence <br />=submitted at this hearing, whether or not any portion thereof is read or discussed. <br />=The communication from the City Planning Co~n~ission stated that the Commission, by a <br />=vote of 6 ayes to 0 noes, approved Zone C-3 subject to the following conditions: <br />=(1) There shall be a two-year time limit in which to satisfy the following conditions <br />~and finalize this action. If the zoning case filed for this property is not adopted <br />~within two years of the date of introduction of the ordinance, the action taken on <br />~this petition shall be void. A time extension of not more than one year may be <br />}requested of the City Council by letter.
