<br />3 P.M.--Hearing was called on the appeal of Robert A. Moore relative to certain of the
<br />conditions of the City Planning Com-.ission regarding the proposal of Tyler Baptist
<br />Church, et el., to divide approximately 3.2 vacant acres of land into approximately six
<br />lots for residential purposes, situated in the 6800 block of Chadbourns Avenue, located
<br />on the northeasterly side of Chadbourne Avenue northerly of Stover Avenue, in Zone RR,
<br />Tract Map 23625. As heretofore directed by the City Council, the minutes of the City
<br />Planning Commission pertaining to this case are on file and are a part of the evidence
<br />submitted at this hearing, whether or not any portion thereof is read or discussed. The
<br />communication from the City Planning Commission stared that the Commission, by a vote of
<br />6 ayes to 0 noeS, approved sn alternate design of the ~ract map with five, rather than
<br />six, lots, subject to the conditions listed in full in the attachsent to the communica-
<br />tion; determined that the proposed project w~uld not have a significant adverse effect
<br />on the environment; and adopted the staff report and the environmental assessment as
<br />findings. The Planning Director presented departmental recommendations, together with
<br />the applicant's proposed map and the staff alternate map as approved by the Planning CoT
<br />mission. Mr. Harold Grebb, representing the appellant, presented a new map, containing
<br />six lots, and spoke in support of its approval. One written protest was presented and
<br />considered. No oral protests were presented. Followring discussion, the hearing was con-
<br />tinned to July 12, 1988, at 1:30 p.m., with the consent of the developer's representa-
<br />tive, to allow time for review of the new map.

<br />PARCEL MAP 23463 - BOULDER CREEK SOUTHERLY OF CANYON HILL AND WESTERLY OF VIA VISTA
<br />3 P.M.--Hearing was called on the proposal of David Reeves and Michael Noreikas, ec el.,
<br />Parcel Map 23463, to divide approximately 20 vacant acres of land into approximately
<br />four parcels for residential purposes, situated at the end of Boulder Creek Drive south-
<br />westerly of Canyon Hill Drive and westerly of Via Vista Drive, in Zone RC. As hereto-
<br />fore directed by the City Council, the minutes of the City Planning Commission pertain-
<br />ing to this case are on file and are a part of the evideBce submitted at this hearing,
<br />whether or not any portion thereof is read or discussed. The communication from the
<br />City Planning Commission stated that the Commission, by a vote of 4 ayes to 3 noes, ap-
<br />proved the parcel map, subject to the conditions listed tn full in the attachment to the
<br />communication; and determined that the proposed project would not have a significant 'ad-
<br />verse effect on the environment. The Planning Director presented departmental recommen-
<br />dations, together ~rlth maps of the subject property. Messrs. Roger Luebs, Attorney, and
<br />John Jordan, Albert A. Webb Associates, representing the owners of Parcel 17 of Tract
<br />21399, spoke in support of the proposed map as it relates to the property o~ned by their
<br />client. Mr. Luebs presented proposed findings to support the necessary variance.
<br />Mr. Noreikas spoke in support of the proposed map as it relates to his property, identi-
<br />fied as Parcel 18 of Tract 21399. No protests, written or oral, were presented. Ques-
<br />tions from the CIty Council were answered by the property o~ners' representatives and
<br />the City staff. Following discussion, motion was made to close the public hearing, to
<br />approve Parcel Map 23463, subject to the applicable recommended conditions, and provid-
<br />ing for the division of Parcel 17, Tract 21399, into two five-acre parcels, but denying
<br />the further division of Parcel 18, Tract 21399; to require a covenant to be placed on
<br />the subject properties prohibiting any further subdivision, to require the applicant's
<br />engineer to meet with City staff prior to final map preparation to determine the loca-
<br />tion of the dividing line between the two new five-acre parcels, with the northerly line
<br />of Parcel 3 to be moved as far south as possible while maintaining the five-acre lot
<br />size, to determine that approval of the parcel map would not have a significant adverse
<br />environmental effect, and to adopt the variance findings presented by Mr. Luebs.

<br />Mayor Brown excused himself at this time, and Mayor Pro Tempore Clarke assumed the Chair
<br />and presided.
