CITY OF RIVERSIDE <br /> <br />COUNCI LMEMBERS <br /> <br />Minutes of Regular Meeting of the City Council ',, <br />Date of Meeting:April 24, 1990 <br /> ,, <br />Time of Meeting= 3 P.M. \ ', <br />Place of Meeting: Council Chamber, City Hall ~\'~\ <br /> <br />Roll Call: <br /> <br />The Invocation was given by Captain Terry Knapstead, Salvation Army. <br /> <br />The Pledge of Allegiance was given to the Flag. <br /> <br />MINUTES <br />The Minutes of the Meeting of April 17, 1990, were approved as submitted. <br /> <br />'Present <br /> <br />Motion <br />Second ,X, <br />.All Ayes <br /> <br />PUBLIC HEARINGS BEFORE THE CITY COUNCIL AT 3 P.M. <br /> <br />AMENDMENT TO CITY CONFLICT OF INTEREST CODE - BUDGET ADVISORY COMMITTEE - RESOLUTION <br />3 P.M.--Hearing was called to consider amending the City of Riverside conflict of inter- <br />est code by adding the Budget Advisory Committee to those who file Form 730, pursuant to <br />Government Code Section 87306. A conflict of interest code designates those employees, <br />members, officers or consultants who make or participate in the making of decisions <br />which may affect financial interests and who must disclose those interests on financial <br />disclosure statements. A written report was presented from the City Clerk, concurred in <br />by Assistant City Attorney Confer, recommending that the City Council (1) hear and con- <br />sider objections and comments to the proposed amendment to the Conflict of Interest <br />Code; and (2) close the public hearing, and adopt the appropriate resolution amending <br />the Code for City board and commission members to add the Budget Advisory Committee to <br />those boards and commissions which are required to file Statements of Economic Inter- <br />ests. No one was present wishing to speak on the matter. No written protests were pre- <br />sented. The public hearing was officially closed; and Resolution No. 17421 of the City <br />Council of the City of Riverside, California, Amending Resolution No. 17397 by Amending <br />in Its Entirety Appendix A to Add Budget Advisory Committee Members to the List of Those <br />Who Are Designated Employees Under the Terms of the Conflict of Interest Code, was pre- <br />sented; and the title having been read, and further reading waived by the unanimous con- <br />sent of Councilmembers present, was adopted. <br /> <br />ACQUISITION OF REAL PROPERTY BY EMINENT DOMAIN - OFF-SITE STORM DRAIN EASEMENT FOR TRACT <br />20393-3 - RESOLUTION <br />3 P.M.--Hearing was called on the proposed acquisition by the City of Riverside, through <br />its powers of eminent domain, of a required storm drain easement for development of <br />Tract 20393-3 in the City of Riverside. A written report was presented from the Aoting <br />City Manager and the Administrative Services Director, concurred in by the City Attorney <br />and the Public Works Director, recommending that the City Council adopt the appropriate <br />Resolution of Necessity and authorize the City Attorney to commence eminent domain pro- <br />ceedings to acquire the needed storm drain easement. No one was present wishing to <br />speak on the matter. No written protests were presented. The hearing was officially <br />closed; the recommendation was approved as presented; and Resolution No. 17422 of the <br />City Council of the City of Riverside, California, Making Findings and Determinations <br />Relating to the Acquisition by Eminent Domain of an Easement on Certain Real Property <br />Necessary for Off-Site Storm Drainage for Tract 20393-3 in the City of Riverside; and <br />Authorizing the City Attorney to Commence and Prosecute Proceedings in Eminent Domain, <br />was presented; and the title having been read, and further reading waived by the unani- <br />mous consent of Councilmembers present, was adopted. <br /> <br />FURTHER HEARING - ZONING CASE V-9-823 (REVISED) - SEVENTH BETWEEN OTTAWA AND DWIGHT - AP- <br />PEAL - CONTINUED <br />3 P.M.--Further hearing was called on the appeal of Rot Burt, General Partner, Oak Tree <br />Limited Partnership, from the decision of the Board of Administrative Appeals and Zoning <br />Adjustment in denying his request for a revised variance to delete a condition of ap- <br />proval of a previously approved variance case requiring all tenants to be 55 years of <br />age or older within an apartment complex located at 1910, 1920, 1928, 1938 and 1946 Sev- <br />enth Street, situated on the south side of Seventh Street between Ottawa Avenue and <br />Dwight Avenue, in Zone R-3, Zoning Case V-9-823 (Revised). The hearing had been contin- <br />ued from March 6, 1990, and April 10, 1990, and referred to the City Council Utility <br />Services/Land Use/Energy Development Committee. In consideration of the recommendation <br />from the Committee, the hearing was continued to May 8, 1990, at 2 p.m. <br /> <br />FURTHER HEARING - ZONING CASES C-39-878 (REVISED) AND C-30-878 (REVISED) - 3445 AND <br />3487 MADISON - APPEAL WITHDRAWN <br />3 P.M.--Further hearing was called on the appeal of Linda Sheridan, Sheridan & Associ- <br />ates, on behalf of Carl Karcher Ent., Inc.
