Southern California Edison Company, Orange County Superior Court Case No. 49~192; pursu- ant to Gover~ent Code Sec=ion 5~956.8 to give ins=ruc=ions to ~he City' s negotia=or re- ~arding nego=ia~ions ~h the curren~ lessee of the Fai~oun~ Park Golf Course for the continued leasing of =he Course~ and =o confer wi=b its a==omey regardin~ pending liti- ga=ion pursuant to Gover~en~ Code Section 5~956.9(b)(1) in that ~here is significan~ exposure ~o li=i~a~ion. The Mayor and Members of the Ci=y Council recessed to =he Conference Room adJoinin~ the Council Chamber. The Mayor and Members of the Ci=y Council resumed to =he Council Chamber. Pursuant to =he above closed sessions a~ ~thou= foml mo=ion, the City Council autho- rized execution of the Se~lemen= Agre~ent and Mural Release ~=ween the City of A~- helm, City of Riverside and Southern California Edison C~pany. The Mayor excused herself at ~his time and ~yor Pro T~pore Buster ass~ed =he Chair and presided. P~LIC HE~INGS BEFORE ~ CI~ C0~CIL AT 3 ZONING CASE R-29-890 (~VISED) - ~939 ~INGTON - ~ZONING - 0~IN~ I~ODUCED 3 P.M.--Hearing ~s called on =he proposal of Neil Frank Troquato =o place an approxi- mately three-foo~ bF 106-foo~ s=rip of land a~ &939 Arlington Avenue, developed landscapin~ and off-s=ree= par~ for an office buil~ng, situsred a= the northeast corner of Arlin~=on Avenue and Valencia Stree=, in Zone RO and remove the s~e from Zone R-1-65; ~th the City Council ~o also consider supplemen=ing =he req~s=ed zo~ng Zones S and X, Zo~ng Case R-29-890 (Revised). As heretofore direc=ed by =he City Coun- cil, the minu=es of =he Ci=y Planning C~ission pertai~ng to ~his case are on file and are a par= of =he evidence su~i=ced a= this hearing, ~e=her or not any pot=ion thereof is read or discussed. ~e comunica=ion from nhe City Plan~ng C~ission s=a=ed ~he Comission, by a vo=e of 7 ayes to 0 noes, approved Zones RO-S-1, subjeer to the fol- lo~n~ conditions: (1) ~ere s~ll be a =wo-year rime limit in which to sa=isfy the fol- lo~n~ condi=ions and finalize ~his action. Subsequen~ one-year ~ime extensions ~y ~ granted by the Ci=y Council upon reques= by ~he applican~. Any ex=ension of rime beyond five years may only be ~ran~ed after an advertised public hearing by ~he Ci=y Council; (2) Zoos R0-S-1 (Res=ricted Office and ~e-S~oU Heigh= of Buildings Combi~ Zones) shall be applied; (3) In approvin~ =his case, it is found that this proposed proJec= is consisten~ ~=h =he exisEing General Plan for =he Ci=y of Riverside based on subs=an~ial evidence discussed in this repor=. There is not substantial evidence in the record ~hat =he project ~11 in=effete ~th the revised General Plan currently bein~ prepared by City; (~) Parcel ~p Waiver ~-37-901 or i=s equivalen= to incorpora=e =he properry ~o be rezoned as par~ of =he adJacen= parcel =o ~he sou=h shall be finalized prior ~o or concurren=ly wi=h =he adoption of =his case; (5) In approving ~his case, i= ~s ~en de- ~emined ~ =here is no evidence before the Ci=y =~= =he proposed proJec= ~11 have any potential for adverse effec= on ~ldlife resources and the impac=s of the projec= are found co be de mini~s pursuan~ to Section 711.4 of ~he Fish and G~e C~e; (6) Deed for widenin~ Valencia S~ree~ ~o 33 fee~ from mon~en= cen=e=line =o Public Works Depart- men~ specificazions; (7) Installation of curb and ~ut=er a= 20 fee~ f=~ monumen= center- line, sidewalk and ma~ching pav~en= on Valencia Street ~o Public Works Departmen= speci- fications; (8) Off-sire improv~en~ plans =o be approved by ~he Public Works Departmen= and a sure=y pos=ed to guaran=ee =he required off-site improv~en=s prior =o adop=ion of =his zoning case; and (9) ~e applican~ may make a cash pa~enn in lieu of cons=ruc=ing all of ~he required off-sire improv~en=s and prepara=ion of off-site improvemen= plans; de=emined nhat ~he proposed rezo~ng would no~ ~ve a si~nifican~ adverse environmen=al effect~ and adop=ed the s=aff repor= and =he enviro~en=al assessmen= as findings. The Planni~ Director presented alepar=mental recomenda=ions, together ~th maps of area. No one was presen= ~shing to speak on ~he ma~ter. No protests, ~i==en or oral, were presented.
