X{ <br /> <br />There being no business to be conducted, the meetings were adjourned; and the body recon- <br />vened as the City Council of the City of Riverside. <br /> <br />PUBLIC HEARINGS BEFORE THE CITY COUNCIL AT 3 P.M. <br /> <br />ZONING CASE RZ-008-923 - 6830 PALM - REZONING APPROVED - ORDINANCE INTRODUCED <br />3 P.M.--Hearing was called on the proposal of Joseph Hubbard, Zoning Case RZ-008-923, to <br />place approximately 0.23 vacant acre of land at 6830 Palm Avenue, situated at the north- <br />east corner of Palm Avenue and Luther Street, in Zone RO and remove the same from Zone <br />R-1-65; with the City Council to also consider supplementing the requested zoning with <br />Zones S and X. As heretofore directed by the City Council, the minutes of the City Plan- <br />ning Commission pertaining to this case are on file and are a part of the evidence sub- <br />mitted at this hearing, whether or not any portion thereof is read or discussed. The <br />communication from the City Planning Commission stated that the Commission, by a vote of <br />7 ayes to 0 noes, approved Zones RO-S-1 subject to the following conditions: (1) There <br />shall be a two-year time limit in which to satisfy the following conditions and finalize <br />this action. Subsequent one-year time extensions mey be granted by the City Council <br />upon request by the a~plicant. Any extension of time beyond five years may only be <br />granted after an advertised public hearing by the City Council; (2) Zones RO-S-1 (Re- <br />stricted Office and One-Story Height of Buildings Combining Zones) shall be approved for <br />the entire site. The existing two-story structure would become non-conforming. Prior <br />to adoption of this case, the applicant shall record a covenant to the approval of the <br />Planning and Legal Departments acknowledging that the second story is non-conforming and <br />restricting the use of the second story of the existing structure for storage purposes <br />only; (3) Prior to adoption of the rezoning case, the existing dwelling shall be re- <br />moved, relocated or demolished; or, if it is to be converted to an office, the applicant <br />shall submit plans into plan check that meet applicable Zoning, Building and Fire Codes. <br />The applicant shall also secure variances as necessary to convert the existing dwelling <br />to office uses. A separate application and filing fee will be required. Building per- <br />mits shall be issued for the office conversion concurrently with the adoption of this re- <br />zoning case; (4) If the existing residence is to be converted to an office, the plot <br />plan, building elevations, landscaping, irrigation and sign plans must be submitted to <br />the Design Review Board for review and approval. A separate application and filing fee <br />will be required; (5) The provision of utility easements, water, street lights and elec- <br />trical underground and/or overhead facilities and fees in accordance with the rules and <br />regulations of the Public Utilities Department; (6) In approving this case, it has been <br />determined that there is no evidence before the City that the proposed project will have <br />any potential for adverse effect on wildlife resources and the impacts of the project <br />are found to be de minimis pursuant to Section 711.4 of the Fish and Game Code; (7) Deed <br />for widening Palm Avenue to 44 feet from monument centerline to Public Works Department <br />specifications; (8) Installation of curb and gutter at 32 feet from monument centerline, <br />sidewalk and matching paving on Palm Avenue to Public Works Department specifications; <br />(9) Removal of existing improvements on Palm Avenue to Public Works Department specifica- <br />tions; (10) Deed for widening Luther Street to 33 feet from monument centerline to Pub- <br />lic Works Department specifications; (11) Installation of curb and gutter in area of <br />curb return and transition on Luther Street to Public Works Department specifications; <br />(12) Off-site improvement plans to be approved by the Public Works Department and a <br />surety posted to guarantee the required off-site improvements prior to final adoption of <br />this zoning case; (13) Installation of an access ramp for the handicapped at Palm Avenue <br />and Luther Street; (14) Removal and/or relocation of irrigation facilities as required; <br />(15) Removal and/or relocation of trees as required; (16) Size, number and location of <br />driveways to Public Works Department specifications; and (17) The applicant has the op- <br />tion to make a cash payment in lieu of construction of and plan preparation for the re- <br />quired off-site improvements on Palm Avenue and Luther Street; and determined that Zones <br />RO-S-1 would not have a significant adverse effect on the environment.
