King, Van Daele Development <br />Corporation, from the decision of the Planning Commission in failing to approve their <br />proposal to establish an approximately 104-unit planned residential development <br />(approximately 52 one-bedroom and 52 two-bedroom apartments) including parking <br />and private and common open space on approximately 4.5 acres at 1046 Spruce Street, <br />situated on the southerly side of Spruce Street westerly of Walkins Drive, in Zone R- 1 - <br />65. In conjunction with this case, consideration will also be given the determination <br />by the Planning Commission that the proposed project will not have a significant effect <br />on the environment, and that a Negative Declaration be adopted. Pat Van Daele, <br />representing Van Daele Development Corporation, spoke in support of the appeal. One <br />written protest was presented and considered. Following discussion, the public hearing <br />was officially closed. The City Council (1) approved Zoning Case PD-003-989 subject <br />to the recommended conditions of approval based on the following findings: (A) The <br />proposed R-3 Zoning is consistent with the General Plan Land Use Designation and <br />will facilitate development that is consistent with that existing in the area.; and (B) The <br />proposed apartment complex is well-designed and generally complies with Code <br />requirements, with the exception of several variances which staff supports.; (2) adopted <br />the staff report, Variance Justification Forms, and environmental assessment as <br />findings; (3) upheld the Planning Commission's determination that the proposed <br />project would not have a significant effect on the environment because mitigation <br />measures have been required and concurred in the adoption of a Mitigated Negative <br />Declaration; and (4) determined that the project would not have an adverse effect on <br />wildlife resources and the impacts of the project are found to be de minimis pursuant to <br />Section 711.4 of the Fish and Game Code. <br /> <br /> Further, the Planning Director was requested to include garage/parking <br />requirements together with other proposed Planned Residential Development <br />Code changes to be presented to the City Council Utility Services/Land Use/Energy <br /> <br />Motion <br />Second <br />All Ayes <br /> <br />X <br /> <br />X <br /> <br />84-271 <br /> <br /> <br />
