RESOLUTION NO. 19037 <br /> <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br /> RIVERSIDE, CALIFORNIA, APPROVING THAT CERTAIN <br /> DISPOSITION OF PROPERTY OF THE REDEVELOPMENT AGENCY <br /> OF THE CITY OF RIVERSIDE ACQUIRED IN WHOLE OR IN PART <br /> WITH TAX INCREMENT FUNDS AND ADOPTING A MITIGATED <br /> NEGATIVE DECLARATION <br /> <br /> WHEREAS, The Redevelopment Agency of the City of Riverside, <br />California, ("Agency") has approved the execution of a Disposition and Development <br />Agreement ("Agreement") by and between the Agency and Lee & Associates <br />Commercial Real Estate Services, Inc. ("Lee & Associates"), a copy of which has been <br />made available for public inspection and copying in the City Clerk's office; and <br /> <br /> WHEREAS, the property being conveyed by the Agreement was <br />acquired in whole or in part with tax increment funds received by the Agency <br />pursuant to Health and Safety Code Section 33670; and <br /> <br /> WHEREAS, Health and Safety Code Section 33433 requires the City <br />Council, as the legislative body of the Agency, to approve the sale of the property to <br />be conveyed by the Agreement; and <br /> <br /> WHEREAS, the Summary Report required by Health and Safety Code <br />Section 33433 was made available for public inspection and copying; and <br /> <br /> WHEREAS, notice of this public hearing was published for two <br />consecutive weeks in a newspaper of general circulation in the community on <br />January, 14 and 20, 1997; and <br /> <br /> WHEREAS. the City's staff has determined that the execution of the <br />Agreement remains within the scope of the previously adopted mitigated negative <br />declaration under Case No. EP-008-967, approved by the City's Planning <br />Commission on January 9, 1997, and as mitigated will not have a significant effect <br />on the environment; and <br /> <br /> WHEREAS, pursuant to the foregoing, an initial study and a mitigated <br />negative declaration have been prepared pursuant to the California Environmental <br />Quality Act ("CEQA"), the State CEQA Guidelines and the City's CEQA Guidelines; <br />and <br /> <br /> WHEREAS, the City provided copies of the initial study and negative <br />declaration; and <br /> <br /> WHEREAS, the City has considered all comments received regarding the <br /> negative declaration; and <br /> <br /> WHEREAS, the City has carefully reviewed the final negative declaration <br /> and all of the information contained in the records pertaining to the Agreement. <br /> <br /> <br />
