RIVERSIDE PUBLIC UTILITIES <br /> um <br /> Board Memorandum <br /> o d <br /> BOARD OF PUBLIC UTILITIES DATE: October 1, 2010 <br /> ITEM NO. 6 <br /> SUBJECT: NON-EXCLUSIVE LICENSE AGREEMENT WITH WESTERN MUNICIPAL WATER <br /> DISTRICT FOR USE OF WHITEGATES NO. 2 RESERVOIR <br /> ISSUE: <br /> That the Board of Public Utilities consider approval of the proposed License Agreement with Western <br /> Municipal Water District ("WMWD"), for use of the Whitegates No. 2 Reservoir (the "Property"), Assessor <br /> Parcel No. 243-220-006 and 243-220-052 located southeasterly of the intersection of Green Orchard Place <br /> and Spencer Court. <br /> RECOMMENDATION: <br /> That the Board of Public Utilities recommend that the City Council approve the License Agreement with <br /> Western Municipal Water District(WMWD) for Whitegates 2 Interconnection—Whitegates 2 Reservoir, <br /> BACKGROUND: <br /> Like the City of Riverside Public Utilities [the"Utility"], WMWD has existing water rights in the Bunker Hill & <br /> Riverside/Colton Water Basins with the need to transport water. Riverside and WMWD have previously <br /> executed an agreement entitled"Cooperative Agreement for Water Production and Conveyance between City <br /> of Riverside and Western Municipal Water District"executed March 30, 2009 (the"Wheeling Agreement"). <br /> The Wheeling Agreement calls for Riverside to produce water by ground water extraction, to transport <br /> ("wheel") WMWD's water through Riverside's transmissionldistri bubo n system, and deliver that water to <br /> WMWD at various points, with one interconnection point being Whitegates No. 2 Reservoir. <br /> On April 1, 2010,the Utility granted WMWD a Temporary Right of Entry permitting WMWD to proceed with <br /> the construction of the interconnection improvements located within the Property. The improvements have <br /> been constructed and the Utility and WMWD wish to enter into a 30-year license agreement permitting <br /> WMWD ingress/egress access onto the Property for the purpose of maintaining the interconnection <br /> improvements, as itemized on Exhibit B of the attached license agreement. WMWD will pay a onetime$150 <br /> non-refundable processing fee and as further consideration, WMWD agrees to maintain the Property in a <br /> neat and clean condition, free of invasive landscaping, weeds, trash and surface obstructions. <br /> FISCAL IMPACT: <br /> There is no fiscal impact associated with this report. <br /> Prepared by: Gary L.
