ElRIVERSIDE PUBLIC UTILITIES <br /> W& Board Memorandum <br /> PUBLIC UTILIIIPS <br /> BOARD OF PUBLIC UTILITIES DATE: August 6, 2010 <br /> ITEM NO: 7 <br /> SUBJECT, FIRST AMENDMENT TO NON-EXCLUSIVE LICENSE FOR USE OF AB BROWN <br /> SPORTS COMPLEX WITH AMERICAN YOUTH SOCCER ORGANIZATION <br /> ISSUE: <br /> That the Board of Public Utilities consider approval of the proposed amendment to the License Agreement <br /> with American Youth Soccer Organization, Region 47("AYSO"),for use of the Ab Brown Sports Complex(the <br /> "Complex"), Assessor Parcel No.246-060-001 (Exhibit A). <br /> RECOMMENDATION: <br /> That the Board of Public Utilities recommend that the City Council approve the First Amendment to the Non- <br /> Exclusive License Agreement with AYSO. <br /> BACKGROUND: <br /> In 1992,the City of Riverside(City),through its Public Utilities Department,entered into a License Agreement <br /> with the AYSO for use of the 56-acre Complex. The License Agreement permits AYSO to use the Complex <br /> for playing and teaching soccer under its youth soccer program. The agreement expired on June 30, 2010. <br /> The AYSO has requested an extension of the License Agreement for an additional two years,through June <br /> 30, 2012. The Utility supports extension of the License Agreement, with additional terms and conditions <br /> included in the proposed amendment providing for AYSO to maintain the premises in a neat and clean <br /> condition free of all weeds, trash and refuse, and to keep any walls, fences, gates, signs and any other <br /> improvements adjacent to the licensed premises free from graffrti. As has been the case since inception of <br /> this License Agreement, the Utility continues to reserve its groundwater rights, including the installation of <br /> pipelines, wells, water treatment or other equipment over all or any portion of the licensed property without <br /> further consent required from the AYSO. <br /> FISCAL IMPACT: <br /> Approval of the extension reduces costs to the Water Fund as maintenance of the complexwill continue to be <br /> paid by AYSO. <br /> Prepared by: Gary L.
