W A T E R I E N E R 5 Y , L I F E <br /> RIVERSIDE PUBLIC UTILITIES <br /> Board Memorandum <br /> P U B L I C U T I L I T I E S <br /> BOARD OF PUBLIC UTILITIES DATE: April 2, 2010 <br /> ITEM NO: 5 <br /> SUBJECT: AMENDMENT NO. 4 TO INTERIM AGREEMENT FOR THE REMOVAL OF <br /> PERCHLORATE AND AMENDMENT NO. 2 TO THE AGREEMENT WITH LOCKHEED <br /> MARTIN CORPORATION FOR REMOVAL AND TREATMENT OF <br /> TRICHLOROETHYLENE <br /> ISSUE: <br /> Consideration of the fourth amendment to the 2002 Interim Perchlorate Agreement and the second <br /> amendment to the 1998 Trichloroethylene Agreement between the City of Riverside (City) and Lockheed <br /> Martin Corporation, to expand treatment to include the City's Raub 7 Well in the San Bernardino Basin area. <br /> RECOMMENDATIONS: <br /> That the Board of Public Utilities recommend that the City Council: <br /> 1. Approve Amendment No.4 to the October 29, 2002 Interim Agreement for the removal of Perchlorate <br /> from Water Extracted from Four City of Riverside Wells; and <br /> 2. Approve Amendment No. 2 to the November 10, 1998 Agreement for the Removal and Treatment of <br /> Trichloroethylene from Water Extracted by City of Riverside Wells. <br /> BACKGROUND: <br /> On November 10, 1998, the City Council approved the Agreement for Remediation of Trichloroethylene <br /> (1998 TCE Agreement). On October 22, 2002,the City Council approved an Interim Agreement for Removal <br /> of Perchlorate from Four Wells (2002 Interim Perchlorate Agreement). On December 9, 2003, the City <br /> Council approved Amendment No. 1 to the 2002 Interim Perchlorate Agreement. On February 22, 2005,the <br /> City Council approved the Amendment No. 2 to the 2002 Interim Perchlorate Agreement. On May 15, 2007, <br /> the City Council approved the Amendment No. 3 to the 2002 Interim Perchlorate Agreement and Amendment <br /> No. 1 to the 1998 TCE Agreement. <br /> Since 1998, Riverside Public Utilities (RPU) and Lockheed Martin Corporation (LMC) have worked <br /> cooperatively toward remediation of trichloroethylene(TCE)and perchlorate from groundwater extracted from <br /> RPU wells in the San Bernardino basin area. The Proposed Amendment No. 4 to the Interim Perchlorate <br /> Agreement and proposed Amendment No. 2 to the TCE Agreement provide for treatment of the Raub 7 Well. <br /> Raub 7 Well was constructed in 2009 and was funded in large part by LMC. The well is being treated <br /> through the Raub Regional Water Treatment Plant that was funded and constructed by LMC. <br /> FISCAL IMPACT: <br /> There is no fiscal impact associated with this report. Lockheed Martin Corporation will reimburse the City of <br />
