Whit R EN E C, Y I it c <br /> RIVERSIDE PUBLIC UTILITIES <br /> Board Memorandum <br /> PUBLIC UTILITIES <br /> BOARD OF PUBLIC UTILITIES DATE: November 4, 2011 <br /> ITEM NO: 4 <br /> SUBJECT: FIRST AMENDMENT TO UTILITY AGREEMENT NO. 21731 BETWEEN CITY OF <br /> RIVERSIDE PUBLIC UTILITIES AND RIVERSIDE COUNTY TRANSPORATION <br /> COMMISSION <br /> ISSUE: <br /> That the Board of Public Utilities consider approval of the First Amendment to Utility Agreement No. <br /> 21731 with the Riverside County Transportation Commission (RCTC) for the relocating of City of <br /> Riverside Public Utilities (RPU) facilities along State Route (SR) 91. <br /> RECOMMENDATION: <br /> That the Board of Public Utilities recommend that the City Council: <br /> 1. Approve the First Amendment to Utility Agreement No. 21731 between RPU and RCTC for the <br /> relocation of RPU water facilities; and <br /> 2. Authorize the City Manager, or his designee, to execute any other amendments for Utility <br /> Agreements between RPU and RCTC for the relocation of water and electric facilities along <br /> SR91, to increase either the reimbursable amount or the term of those agreements. <br /> BACKGROUND: <br /> On June 22, 2010, the City Council approved Utility Agreement No. 21731 between RPU and RCTC for <br /> the abandonment of the Freeway Well as part of the utility relocation work for RCTC's project to widen <br /> SR 91 for the construction of two (2) High Occupancy Vehicle (HOV) lanes. The original Utility <br /> Agreement amount was for $17,500 to be paid for by RCTC which represented 50% of the estimated <br /> project cost of $35,000 to be shared equally between RCTC and RPU. <br /> The project was completed on May 6, 2011 at a total cost of$57,192. The increase in cost resulted from <br /> a thicker than anticipated concrete well pad which was removed, and the need for additional shoring to <br /> accommodate the abandonment of the well casing at a deeper than typical depth below ground surface. <br /> On the basis of these changes, RCTC has agreed to amend their share of project costs in Utility <br /> Agreement No. 21731 from the original amount of $17,500 to a revised amount of $28,596. This <br /> represents their 50% portion of the actual total project cost of $57,192 of which the remaining 50% is to <br /> be paid for by RPU. <br /> FISCAL IMPACT: <br /> The total project cost is $57,192. Under the terms of the First Amendment to the Utility Agreement, <br /> RCTC will reimburse RPU $28,596. <br />
