W A T E R E N E R G Y ! l F t <br /> RIVERSIDE PUBLIC UTILITIES <br /> Board Memorandum <br /> PUBLIC UTILITIES <br /> BOARD OF PUBLIC UTILITIES DATE: August 3, 2012 <br /> ITEM NO: 5 <br /> SUBJECT: FIELD USE AGREEMENT WITH AMERICAN YOUTH SOCCER ORGANIZATION — <br /> TWO-YEAR EXTENSION <br /> ISSUE: <br /> That the Board of Public Utilities consider approval to extend the Right of Entry Agreement with <br /> American Youth Soccer Organization (AYSO) through August 31, 2014. <br /> RECOMMENDATION: <br /> That the Board of Public Utilities recommend that the City Council approve the Right of Entry Agreement <br /> with American Youth Soccer Organization through August 31, 2014. <br /> BACKGROUND: <br /> AYSO has leased Utility owned property at the Ab Brown Soccer Complex for the past 30 years. Under <br /> the terms of the original agreements, AYSO and the City Parks, Recreation and Community Services <br /> Department developed the existing soccer fields, parking lots and concession buildings. AYSO currently <br /> provides all maintenance of the facilities, including watering, mowing, weed control, graffiti abatement <br /> and security. <br /> The last amended License Agreement expired on July 1, 2012. Staff has not identified a current <br /> operational need for this property and, therefore, recommends extending the Right of Entry Agreement <br /> for two years through August 31, 2014. While RPU does not have a current operational need for the <br /> property, the property is held as a long-term investment and a potential source of water for future <br /> needs. The passive use of the property by AYSO does not impede RPU's use of the property. <br /> Under the terms of the Right of Entry Agreement, AYSO will continue to provide all maintenance on the <br /> premises as described above. The cost of maintaining the land owned by the Utility is completely offset <br /> through the efforts of AYSO. <br /> FISCAL IMPACT: <br /> There is no fiscal impact associated with the Right of Entry Agreement. <br /> Prepared by: Kevin S.
