W A f E Fi E N E R G Y 11 F F. <br /> RIVERSIDE PUBLIC UTILITIES <br /> Board Memorandum <br /> PUBLIC UTILITIES <br /> BOARD OF PUBLIC UTILITIES DATE: January 4, 2013 <br /> ITEM NO: 5 <br /> SUBJECT: NON-EXCLUSIVE LICENSE AGREEMENT WITH HIGHGROVE WORKFORCE <br /> HOUSING,L.P., FOR A PORTION OF THE GAGE CANAL PROPERTY LOCATED ON <br /> MICHIGAN STREET, SOUTHERLY OF CENTER STREET, HIGHGROVE <br /> ISSUE: <br /> The issue for Board of Public Utilities consideration is approval of a Non-Exclusive License Agreement with <br /> Highgrove Workforce Housing, L.P. ("Licensee"),for use of a portion of Gage Canal property located along <br /> Michigan Street, southerly of Center Street, in Highgrove ("Property"). <br /> RECOMMENDATIONS: <br /> That the Board of Public Utilities recommend that the City Council: <br /> 1. Approve the License Agreement with Highgrove Workforce Housing, L.P.; and <br /> 2. Authorize the City Manager, or his designee, to execute the License Agreement. <br /> BACKGROUND: <br /> Licensee, in collaboration with the Riverside County Housing Authority, is constructing an 89-unit affordable <br /> housing project("Project") on Licensee's property, located directly adjacent to the Gage Canal right-of-way <br /> along Michigan Street in the City of Highgrove. As a condition of approval by Riverside County, Licensee <br /> must construct a secondary emergency only vehicle ingress/egress gate. <br /> The Non-Exclusive License Agreement permits Licensee use of approximately 1,200 square feet of the Gage <br /> Canal to construct and maintain the County required emergency only vehicle ingress/egress gate and related <br /> improvements. As consideration, Licensee will pay the Utility a one-time processing fee of $150, and an <br /> annual fee of$300("Base Rent")with a 3%annual increase. Licensee is required to maintain the Premises, <br /> including but not limited to protecting the Gage Canal pipeline. <br /> FISCAL IMPACT: <br /> The Licensee will pay a one-time processing fee of$150 and Base Rent of$300 with annual 3% increases. <br /> Prepared by: Kevin Milligan, Public Utilities Assistant General Manager <br /> Approved by: David H.
