BOARD OF PUBLIC UTILITIES DATE: October 4, 2013 <br />ITEM NO: 10 <br />SUBJECT: PUBLIC UTILITIES ANNUAL RENEWABLES PORTFOLIO STANDARD <br />COMPLIANCE FILING <br />ISSUE: <br />The item for Board of Public Utilities consideration is approval of Riverside Public Utilities' (RPU) 2011- <br />2012 annual Renewables Portfolio Standard ( "RPS ") compliance report to the California Energy <br />Commission ( "CEC "), as required by the California Renewable Energy Resources Act ( "SBX1 -2 "). <br />RECOMMENDATIONS: <br />That the Board of Public Utilities recommends that the City Council: <br />1. Approve RPU's 2011 -2012 RPS compliance report — 2013 Annual RPS Progress Status Report <br />for Calendar Years 2011 and 2012 and Report for 2004 -2010 Historic Carryover Claims and <br />direct staff to file this report with the CEC, as required by SBX1 -2; <br />2. Authorize staff to file for the Historic Carryover of RPS resources as provided in its RPS <br />Procurement Plan; <br />3. Authorize staff to file the CEC detailed forms with RPU data once the final versions are <br />released; <br />4. Delegate the approval of future CEC annual RPS compliance report filings to the Board of <br />Public Utilities; and <br />5. Delegate to the Public Utilities General Manager, or his /her designee, authority to sign the <br />associated RPS compliance report attestation forms upon approval of the annual RPS <br />compliance report by either City Council or Board of Public Utilities as applicable. <br />BACKGROUND: <br />SBX1 -2 was signed by the Governor on April 12, 2011. SBX1 -2 revised the State Renewable Energy <br />Resources Program to require that utilities serve 33% of retail sales with energy generated from <br />renewable resources by December 31, 2020. SBX1 -2 contains three separate compliance periods, and <br />defines three categories of renewable resources with progressively increasing requirements for in -state <br />renewable resources. Unlike previous State laws, SBX1 -2 is applicable to publicly owned utilities <br />( "POUs ") such as RPU. <br />The oversight of compliance with SBX1 -2 by POUs is provided by their respective local regulatory bodies <br />and by the CEC. The oversight of compliance by investor owned utilities is provided by the California <br />Public Utilities Commission. <br />In compliance with SBX1 -2, on November 18, and December 13, 2011, the Board of Public Utilities and <br />the City Council, respectively, approved the RPS Enforcement Program. <br />
