W A E R E N E R G Y _ <br /> RIVERSIDE PUBLIC UTILITIES <br /> Board Memorandum <br /> PUBLIC UTILITIES <br /> BOARD OF PUBLIC UTILITIES DATE: August 2, 2013 <br /> ITEM NO: 7 <br /> SUBJECT: SECOND SUPPLEMENT TO COST SHARING AGREEMENT BETWEEN CITY OF <br /> RIVERSIDE PUBLIC UTILITIES AND WESTERN MUNICIPAL WATER DISTRICT — <br /> SEVEN OAKS ENHANCED RECHARGE PROJECT <br /> ISSUE: <br /> The item for Board of Public Utilities consideration is approval of the "Second Supplement to Cost <br /> Sharing Agreement" with Western Municipal Water District for New Conservation Water in the San <br /> Bernardino Basin Area, as well as payments associated with the Seven Oaks Dam projects. <br /> RECOMMENDATIONS: <br /> That the Board of Public Utilities: <br /> 1. Recommend that the City Council approve the Second Supplement to Cost Sharing Agreement <br /> with Western Municipal Water District for New Conservation Water in the San Bernardino Basin <br /> Area (Second Supplement to Cost Sharing Agreement); <br /> 2. Approve the expenditure of$105,000 for Riverside's share of costs incurred between January 1 <br /> and June 30, 2013; and <br /> 3. Approve the expenditure of$1,800,000 for Riverside's anticipated share of costs for Fiscal Year <br /> 2013-14. <br /> BACKGROUND: <br /> Riverside has adjudicated rights to extract and export water from the San Bernardino Bunker Hill Basin <br /> (SBBA). These rights are currently set at 53,426 acre feet per year (AFY) and they represent 22.49% of <br /> the total water rights for the basin. Riverside may increase its extraction/export rights if it participates in <br /> "New Conservation" projects as defined by the Western Municipal Water District of Riverside County et <br /> al., v East San Bernardino County Water District, et al. Judgment issued in 1969 (1969 Judgment). <br /> Due to its standing in the 1969 Judgment, Western Municipal Water District (Western) represents <br /> Riverside's interests with "New Conservation" projects. Two "New Conservation" projects involve <br /> capturing discharge from the Seven Oaks Dam, located east of Redlands. The first project is known as <br /> the Seven Oaks Dam Initial Conservation Project (Initial Project) and the second project is the Seven <br /> Oaks Dam Enhanced Recharge Project (Enhanced Recharge Project). Combined, these two projects <br /> will result in about 10,800 acre-feet per year(AFY) of"New Conservation" water rights. Of this, Riverside <br /> may gain an increase of about 2,430 AFY of export rights. <br /> San Bernardino County Valley Municipal Water District (Valley) and Western have entered into <br /> agreements to complete these two projects. Valley has taken the lead to complete the projects and <br /> Western has agreed to reimburse them for Riverside's portion of the costs. In turn, Riverside and <br /> Western have entered into agreements for Riverside to participate in these "New Conservation" projects. <br /> In prior actions, the Board and City Council have authorized Riverside to enter into three agreements: <br /> Cost Sharing Agreement — Seven Oaks Dam Water Conservation Study and Amendment 1 (January 4, <br />
