W A T E R I E N E R G Y I L I F E <br /> _?�l RIVERSIDE PUBLIC UTILITIES <br /> 191& Board Memorandum <br /> P U B L I C U T I L I I 1 L S <br /> BOARD OF PUBLIC UTILITIES DATE: June 7, 2013 <br /> ITEM NO: 2 <br /> SUBJECT: AUTHORIZATION TO REMOVE PANEL MEMBERS FROM THE MASTER <br /> AGREEMENT FOR THE CONTRACTORS' PANEL FOR ENERGY DELIVERY <br /> WORK <br /> ISSUE: <br /> The item for Board of Public Utilities consideration is approval to terminate Master Agreements with <br /> contractors on the Energy Delivery's Contractor's Panel at the contractors' request. <br /> RECOMMENDATION: <br /> That the Board of Public Utilities authorize the City Manager, or his designee, to terminate Master <br /> Agreement with contractors from the Contractors' Panel for Energy Delivery Construction Work when the <br /> contractor voluntarily requests removal from that contractor's panel. <br /> BACKGROUND: <br /> The Energy Delivery Contractor's Panel was first established in 1999, to streamline the bidding process <br /> for underground structure work to meet the increasing demand for such work. <br /> The firms on the panel are pre-qualified to bid on construction projects under a Master Agreement. The <br /> Master Agreement incorporates all contractual requirements including bonding and insurance. Each bid <br /> is awarded to the lowest responsive bidder by the City of Riverside's (City) Purchasing Division. <br /> Riverside Public Utilities (RPU) only uses the panel for construction projects which are less than <br /> $500,000; projects in excess of this amount are bid through the City's formal competitive bidding <br /> process. <br /> Qualified contractors can join the panel upon request, and execution of the Master Agreement. RPU <br /> periodically advertises a Request For Proposals to add additional members to the panel. Section 1109 <br /> of the City Charter allows waiver of its formal bidding requirements for projects for construction and/or <br /> improvement of any public utility operated by the City, so long as the City Council adopts a resolution by <br /> at least five affirmative votes. On March 23, 2004, the City Council adopted such a resolution, <br /> authorizing the formation of the current panel. <br /> This current Master Agreement was approved by the Riverside City Council, with Public Utilities Board <br /> concurrence, on March 23, 2004 and was amended and restated on March 19, 2010 for an additional <br /> five years through March 31, 2015. This reauthorization allows the City to add new members to the panel <br /> but does not address how panel members may be removed. <br /> On March 11, 2013, RPU received a letter from Mr. Sandy Dennis, Corporate Contracts Administrator of <br /> Doty Brothers Equipment Company, requesting termination of the agreement to withdraw from the <br /> Contractors' Panel. Staff reviewed the work record and determined there are no outstanding disputes <br /> with Doty Brothers Equipment Company. <br />
