<br />, <br /> <br />CITY OF RIVERSIDE <br /> <br />REDEVELOPMENT AGENCY MEMORANDUM <br /> <br />Honorable Mayor & Agency Members <br /> <br />Date: <br />Item No.: <br /> <br />August 14,2001 <br />4 <br /> <br />Subject: APPROVAL OF LEGAL SERVICES AGREEMENT WITH BURKE, WILLIAMS, & <br />SORENSEN, LLP <br /> <br />Background <br /> <br />The Redevelopment Agency ofthe City of Riverside has a number of law firms which have been approved to <br />provide legal services. One of these firms is Covington & Crow, LLP. However, with the recent departure of <br />Eric Vail, Esq., this firm is no longer able to provide redevelopment-related legal services. <br /> <br />Current Issue <br /> <br />Currently, Agency statT is proceeding to engage in a number of redevelopment projects and activities, which <br />require immediate legal assistance. These projects include the drafting of a Disposition and Development <br />Agreement for sale of property and development of AME Manufacturing, Inc., acquisition ofthe Heiting building <br />and the RCC School for the Arts project, Marketplace closeout, and development of a Restaurant Assistance <br />Program. Special legal counsel will be necessary to provide assistance and consultation to staff in conducting the <br />varied aspects of the projects. Mr. Vail was providing legal services for Heiting and Marketplace prior to <br />changing law firms, and Agency staff would like to continue his services on these projects to maintain continuity. <br /> <br />Based upon the redevelopment experience and knowledge of Mr. Vail, the Development Director is <br />recommending that the Agency Board authorize retention of Burke, Williams & Sorensen, LLP ("BWS"), to <br />advise the Agency on such maners and for other legal services as may be required, and the City Attorney, as <br />General Counsel to the Redevelopment Agency, concurs. <br /> <br />Fiscal Impact <br /> <br />BWS is proposing a reduced rate of $165 per hour for Mr. Vail's services, which is a reasonable rate for the type <br />of legal services that he provides. Funds for outside legal services of this nature are included in the Development <br />Department's Project Areas Budgets for FY 2001102.
