BACKGROUND:
Periodically, Riverside Public Ulilities,'RPU) prMetty/facilifies management staff will have properties surveyed
and/or staked to identify property boundaries, A recent land survey of the Canal at Washington Street
revealed that the adjacent property's fence and portion of the driveway is encroaching on the Canal right_ f..
way (Attachment 2). William Stokley, new owner of the 3558 Washington Street property, requests continued
use of the Canal land and has agreed to enter into a License Agreement with the City of Riverside to allow
continued use of 1,045 square feet of the Canal. -rhe License Agreement permits the fence to remain in its
current location and access onto his large rear yard. Staff has determined that continued use of the Canal
encroachment area is acceptable, so long as the property owner permits RPU access to the Canal through
his property via a permanent Access Easement to the City of Riverside (Attachment 3).
The license agreement is for a 10-year term with three additional periods of ten years each. As
consideration, there is an annual license fee of $300; plus Licensee is granting an Access Easement to the
City of Riverside.
2&75
The annual rental revenue is $300,
